i keep getting calls on the company cellphone and everytime i asked them NOT to call cell, due to the fact that this is not MY PRIVATE cellphone, yet they never call me at home. they called our payroll dep. and basicaly got my T4 info, (they said they are verifying my credit application), also started calling my extension, i have gotten 17 calls in 4 days, i was also told that they are preparing paperwork for CIBC for further legal action and after 3 days called back and asked for $$$ in the full amount, i asked what happend to the legal action, the guy said: "we're prepared to give you ANOTHER CHANCE!!!!!" goodthing that i kept a log of all the calls i got from them.
BE VERY CAREFULL, they ALL tell you that "they are calling from THE LEGAL DEP. of NCO Financial" where infact they are probably not licanced to even make call outside of Alberta.

it's not that they call me at the same time, they pass the file to one another. making payments for almost 2 yrs. doesn't make a difference to them either. they are pushing for their target.
need ur contact info. also filed complaints to both levels of government, waiting for their reply till the end of the week, if nothing happens, i'll call my MPP.

i received a call from Scott Barber yesterday at work, he said i'll be receiving a letter by UPS, indicating that they will start garnishing my wages. i'm just waiting to see that letter and see how far they're willing to go and howmuch $$$ they're willing to spend in court to get a judgement. should i consult an atterney?

There's something called Due Process that needs to be respected. They can't just say "oh, we are going to garnishee your wages"

I spend a lot of time planting signs ahead of people that read "DO NOT JUMP" while they are climbing the up-hill battle with student loans and collection agencies. Are you offering them payments?

i got the letter today, here is what it says:
Dear Mr/Mrs **** (they've been calling me since July 07, still don't know if i'm Mr. or Mrs.)
please be advised that your account has been approved for legal action and we will be instructing our solicitor to commence legal proceedings against you unless this account is resolved IN FULL within 10 days from date of this letter.
please be advised that failure to deal with your account voluntarily may result in additional legal fees, garnishment and seizure of assets and/or bank accounts.
if you have any questions or concerns, please contact the undersigned, or forward the balance of your account to 600-10109 106 Street, Edmonton AB T5J 3L7.
Govern yourself accordingly,

Contact CIBC and advise them that you received this letter, and ask them why they arwe suing you even though you are making payments.

2 yrs. ago i called to get my account # and balance, agent verified all my info and updated their file and at the end told me "they don't have any info and i need to contact the collection agency". CIBC doesn't even want to talk to me.

Yup, had to do a lookup to be sure. This is NCO Financial.
I worked for them some time ago. Just for a short time (Thank God), I was only a Skip Tracer, but I really hated it

Contact CIBC and advise them that you received this letter, and ask them why they are suing you even though you are making payments. CIBC has to talk with you becuase it is they who you owe the money to. Ifr they refuse, escalate it to the executive customer response unit.

i just called CIBC and they said:" they don't have a request from NCO to porsue any legal action against me". how ever the agent said that i need to contact NCO for balance on the account.

The letter you received previously (as posted above somewhere) from the collection agency (NCO) states that legal action has been approved. Now, CIBC is telling you that it has not been approved. So, the collection agency has gone above their client (CIBC) and taken the stand that they don't care what CIBC says. You should enlighten CIBC because the collection agency must first request permission fromtheir client to proceed with legal action before doing so. The letter you recevied from NCO states otherwise.

This sort of thing is common, by the way. Collection agencies are the heaviest frustraters of the system.
