i keep getting calls on the company cellphone and everytime i asked them NOT to call cell, due to the fact that this is not MY PRIVATE cellphone, yet they never call me at home. they called our payroll dep. and basicaly got my T4 info, (they said they are verifying my credit application), also started calling my extension, i have gotten 17 calls in 4 days, i was also told that they are preparing paperwork for CIBC for further legal action and after 3 days called back and asked for $$$ in the full amount, i asked what happend to the legal action, the guy said: "we're prepared to give you ANOTHER CHANCE!!!!!" goodthing that i kept a log of all the calls i got from them.
BE VERY CAREFULL, they ALL tell you that "they are calling from THE LEGAL DEP. of NCO Financial" where infact they are probably not licanced to even make call outside of Alberta.

it's not that they call me at the same time, they pass the file to one another. making payments for almost 2 yrs. doesn't make a difference to them either. they are pushing for their target.
need ur contact info. also filed complaints to both levels of government, waiting for their reply till the end of the week, if nothing happens, i'll call my MPP.

i received a call from Scott Barber yesterday at work, he said i'll be receiving a letter by UPS, indicating that they will start garnishing my wages. i'm just waiting to see that letter and see how far they're willing to go and howmuch $$$ they're willing to spend in court to get a judgement. should i consult an atterney?

There's something called Due Process that needs to be respected. They can't just say "oh, we are going to garnishee your wages"

I spend a lot of time planting signs ahead of people that read "DO NOT JUMP" while they are climbing the up-hill battle with student loans and collection agencies. Are you offering them payments?

i got the letter today, here is what it says:
Dear Mr/Mrs **** (they've been calling me since July 07, still don't know if i'm Mr. or Mrs.)
please be advised that your account has been approved for legal action and we will be instructing our solicitor to commence legal proceedings against you unless this account is resolved IN FULL within 10 days from date of this letter.
please be advised that failure to deal with your account voluntarily may result in additional legal fees, garnishment and seizure of assets and/or bank accounts.

2 yrs. ago i called to get my account # and balance, agent verified all my info and updated their file and at the end told me "they don't have any info and i need to contact the collection agency". CIBC doesn't even want to talk to me.

Contact CIBC and advise them that you received this letter, and ask them why they are suing you even though you are making payments. CIBC has to talk with you becuase it is they who you owe the money to. Ifr they refuse, escalate it to the executive customer response unit.

The letter you received previously (as posted above somewhere) from the collection agency (NCO) states that legal action has been approved. Now, CIBC is telling you that it has not been approved. So, the collection agency has gone above their client (CIBC) and taken the stand that they don't care what CIBC says. You should enlighten CIBC because the collection agency must first request permission fromtheir client to proceed with legal action before doing so. The letter you recevied from NCO states otherwise.

First:
Make an initial report.....The agent will take a report for the phone, give all details, making it clear that you are reporting the Agency (NCO), NOT CIBC. This office is the office that gives them a Licenise to be a Collector under the rules of the Free Trading Act. If you are not Licenised, you CAN NOT even pick up the phone in a Collection Agency. Name NCO and each and every individual that contacted you.
Wait for 2 days........Send a fax/email, follow by a registered letter.....Stating that your prefered method of contact is......and you MUST BE IN CONTACT with them. Tell them in the letter that you will allow 48 hours for all their records and all their employees/associates to be notified with your prefered method of contact (Through the office of [YOUR CASE WORKER] at the Alberta Government Services, all calls, correspondance or anything else, to be delt with on your time, not your work time) and if they call you at work thay are in breach of the Fair Trading Act.
MOST IMPORTANT OF ALL!!!! CC: The Case Worker with the file number and all records of calls that were made to you at work, not allowing you to work and preventing you from providing for yourself and family's well-being at a minimum and that you are consulting a Lawyer for the damages and harrasment at work, that has caused problems with your employor.
Trust me.....if those individual Collections Agents see their name on a letter with the name of the Caseworker at Service Alberta, they will leave you alone at work, well Hopfully!!!
I use this method.....on a business matter in the past, and the Collector was crying and kissing my ass.

I finally got NCO to stop calling me during work hrs. with the help of a CIBC CSR, however, I got a call form scott saying that since I did not respond to their letter, they have passed JUDGEMENT agianst me for this account.
Is it possible for them to go to court without notifying me? (a friend of mine was in a simillar situation and plaintif went to court without him knowing it and got a jodgement to garnish his wags, he didn't know until he got his paycheck and there was the deduction). can they do the samething?????
he said that a notice went out today (nov. 29/07) and I should receive it shortly. this letter gives me 15 days to clear this account VOLUNTARILY!!!

If they did not sue you, they cannot obtain a judgment. Call the courthouse where these proceedings would have taken place and see if there is a judgment recorded.

1. it's only been 8 days from the day i got their last letter (i still HAVE 2 days till the letter is deamed refused by me)
2. there is noway that they could have registerd, gone to court and got a judgement.
3. CIBC has NEVER approved legal action.
4. i'm just waiting for the letter to come in and then i'll go and see a lawyer for suing NCO for lying, missreprisentation, harrasment at work.
IF ANYONE FROM NCO SEES THIS, PLEASE LET YOUR BOSSES KNOW THAT A LAWSUIT MIGHT BE COMMING THEIR WAY.....

well.. I would also look for other people that have unduly harassed and threatened by this group and launch a class action suit against them... take no prisoners...
if you can get 100 people that have been harassed and terrorized... I am sure there has, launch a class action, you can even start at 5 people and add more people later...
I am sure that you can find people here that would join you in a class action with a situation that is much like yours...

I'm pretty sure they are lying to you. You need to be served before there can be a court proceeding against you. You need a court proceeding before there can be a judgement.
If you were frustrating their ability to serve you then they could just serve your last address of record and proceed after a given time period. Since they are communicating with you via mail obviously they have your address so this does not apply.
I think it is interesting that you said;
"they have passed JUDGEMENT against me" .
I think what this means is the CSR has passed judgement against you. A pretty meaningless statement but one that allows them to use the scary word "judgement" while not being a outright lie. Anyone can look at a set of facts and issue a judgement. Doesn't mean anything unless the person doing so is a court of competent jurisdiction.

i just got an estatement from our payroll lady that indicates someone from NCO called and tricked her into getting my info by telling her: "he was verifying my credit application."

Colectors are creative, remember. They do and say what works. They decieve others to acquire information. If your payroll person can prove this, and is willing to issue a letter of complaint, it will certainly get the point across to the offending side not to do it again.

I received a similar letter from R. Max Gold Barrister and Solicitor demanding $49,911 in full in ten days "failure to pay this sum as demanded coud result in legal action, which is a matter of public record, being commenced against you. The collection office is NCO. It seems i have several people calling me from there, from several different numbers- some local some 1 800, some withheld. Sometimes it is the computer automated voice and lately there has been someone named Pam with "very important paperwork that's come across her desk and she needs to talk to me before she makes a decision"/
To be honest i try to avoid talking to these people. I am paying NCO an agreed upon modest payment monthly. I don't know where Pam is calling from. But where i used to get calls and then they'd go away I get several daily now. I've had similar letters of this vein in the past, but nothing has happened. If they sue I know they need to go through the proper channels.
I thought the legislation had changed to seven years bankruptcy but i can see that it has not. Does anyone know the latest on that? Does anyone know someone who has been sued and had there wages garnisheed?

As far as i know, if you're making payments, they're NOT to call you, but if you miss a payment, they can AND will start calling.
please read all my blogs and if you think you're being harrassed, let me know, cus i'm about to sue them. i have gotten The Government of Ontario involved in my case as well.
if you want to be on board with my suit, 1st. contact Service Ontario (if you live in ON.) in writting and file a complaint with them.

if they make a deal with a debtor to make regular monthly payments, they are not allowed to call and demand payment, they've already exsausted all the options to collect full balance and made a deal. "this is comming from an Ex-licensed collector"

i just got a call from a Service Ontario Rep. handling my complaint, he said that NCO (Bill Jackson, GM) has told them:"
1, I was abusive to their employees.
2, I refused to cooperate with them regarding this matter.
3, they had no other way of contacting me."
Basically the OPPOSITE of the issues that i had, and he said that his hands are tight and he's going to belive them over me, because this he said / she said, and that these agencies CANNOT lie to the government. (I came out of this the LYING one) and that he's going to close this file.

You are wrong. They are are allowed to contact you because it is a demand debt. If the government or bank rehabltates the laon, then the agreement sticks. Collection agencies are there to collect money. If a debtor is making payments, and the file is assigned to a different collector or section, the collector can call f they truly want to. Unless their client or the Provncial authority, or representative tells them otherwise. Even still - they call despite this.

yesterday I got a bunch of papers, saying that CIBC has filed for court proccedings against me, including court file #, unless i pay the full balance + $950.00 that cost them to file court documents.
NCO was asking for $12,981.84, but these papers say the balance is $12,213.17

Hi Scar
You filed the complaint to the provincial authorities and they sided with the collection agency. This is what normally happens. Unless you have proof of a violaton, they side with them. after talking with you, you indcated that you filed the complaint at the end of November with the provincial authority, and you were served on December 6th by NCO's lawyer.
They are suing you to get even with you for filing a complaint. You have been paying every month like clockwork, and the agency decded to call you at work and see if they could get you to pay more. They bothered you at work with excessive calls - so you filed a complaint.
The next thing to do is escalate this to CIBC's National Collection Office. The queston is why would they agree to sue you because you have been making good payments for a year in good faith.

This message should be taken serously by EVERYONE who is dealing with NCO Financial Servces regarding CIBC student loans. CIBC does not care if you are makng payments or not. The collectection agency in this case can thell the provncial authorities that they sky is purple with pink polkadots and they wll side wth the agency. There is very little protection for student loan borrowers and this is a very good example. Collection agencies do what they want, get what they want, and CIBC could care less.

i've been making minimum $150.00 and as high as $200.00 payment as of Feb. 2006, what will happen to the $$$ that CIBC got?
will the court consider them or the $$$ i've paid is down the drain and i have to pay the $12,213.90 on top of the payments i've made for 22 months?

I am perplexed as to why CIBC would even approve legal action against a client who is demonstratng what you have described. It is a phenomnon. If you were not paying anything wth a clear abilty to pay, then that is different. I think you should write directly to the CIBC Exec. Customer Relations Unit and copy the president's office on that one.

well, i just got a call back from a CIBC Rep. after i wrote to them asking why CIBC is suing me, the agent said that this is a 10 yr. old account and CIBC wants to close it ASAP. call the collection agency and see if they are willing to settle, i did and they refused it. he called them and told me that the agency can accept 70% of the current balance, however, it depends on your income and expences. meaning they can refuse my offer to settle the account @ 70%. and if they do, they'll bring the questionare to the court and tell the judge that i'm making enough $$$ to pay the full balance, what do i do? i have 6 more days left before i have to file a defence statement with the court papers i got last week.

I just got a summary report from Service Ontario, here it is:
We are in receipt of a response to your complaint against NCO Financial Services Inc., Scott Barber, Alym Lalani, Gloria Weileby. (What happened to Sarah Singer???)
As we discussed in our conversation regarding your complaint, there were mistakes made on both sides. The agency has admitted it did make some errors in the handling of your fine and as a result we have issued cautions to all collectors involved as well as the agency. We have also spoke to Bill Jackson (GM) and Andrew Burton (Dist. Manager) and Katia Accirriesi (VP). They have also shown a real concern in regards to the manner in which, you were treated and have now began to put measures in place to ensure collectors would adhere to Ministry gudelines and company policies when performing ther duties.
We trust that you will do your part to ensure that you provide the agency with all relevant information that they requier such as your current address (they got my property report), financial statement regarding current debt (they have pulledmy credit report), and a copy of your most recent paystub (they called our payroll and got everything) and any other information they may need in order to put you on a repayment scheduel (they ask for full payment, and i have been on payment plan with CIBC).

I BET ALL THE LEGAL ACTION THAT HAS BEEN PUT FORWARD BY NCO IS FOR REVENGE, (they got a call from CIBC CSR. and got a warning from the government).

It is very clear that the collection agency is out for the commission. They smell money and feel that you can pay more than what you are currently paying. The written response from the government authority has stated that the agency has mshandled "your file". That is alarming. What do they mean by that? Did they mistreat you, or mishandle your file? This is something you should also write to CIBC because the agency admitted doing something wrong.

I have prepared a letter along with a copy of the letter from government, but CIBC will NOT give me the contact info for Board of directors, CEO/president or any of their exsecutives.

i finally got CIBC's President/CEO's contact info and here is the letter i wrote to him:
December 19, 2007
Dear Mr. McCaughey:
I’m writing to you to bring your attention to activities that NCO Financial Services Inc. (third party collection agency) which CIBC has under contract for collecting delinquent accounts.
This is in regards to my overdue student loan account that CIBC has assigned NCO to collect. I have started to make payments directly to CIBC as of February 2006 and DID NOT miss a payment since then; however, I started getting excessive number of calls (attachment # 1) starting June 2007 from NCO on mobile phone provided to me by my employer, and recently they started calling my extension at work, as result of these calls I was verbally warned by my superior, I wrote to your Customer Care Ctr. on Nov. 29th 2007 an agent called and said: “he spoke to NCO and calls to your cell and work will stop”, calls to my cell and extension stopped, in the meantime (Nov. 22nd 2007), I received a UPS package (attachment
# 2) addressed to my place of work indicating “approved for legal action”, I called National Student Ctr. and agent responding to my call said: “there is no record of a request for legal action on your file”, at her advice I called and filed a formal complaint with your CSR Dep. at the same time I filed a complaint with Government of Ontario.
After few days I got a call from a representative form government saying: “agency has told them the exact opposite of the issues I have complained about, and that since this is a he said / she said, there is nothing that they can do about it and are going to close the file”. On Dec. 18th 2007 I received a summary package (attachment # 3) from the same agent, this report indicates that the agency has admitted to mishandling the file and mistreating me. The agency and the agents involved were issued a cautionary note for their activities and the way they have handled this file.
Also the balance from court papers filed by CIBC is $12,213.90 but NCO is demanding $12,984.81 (attachment #2), this is before they added their legal fees, this is clearly a violation of the Ontario Legislation Act governing collection agencies.
On Dec. 12th 2007 I was summoned for court action on this file naming CIBC as plaintiff not NCO. This action clearly suggests PURE REVENGE, coming from NCO due to the fact that I have been making payments directly to CIBC and them not making commission, also getting a black-eye from government.
I have enclosed all copies of my documents for your review.
Once again this is NOT a complaint; this is just to let you know how your affiliate(s) treat your customers. I also understand that your are extremely busy running one of the largest organizations in Canada, but please review my concerns and let me know if you have any further questions or have any comments.

I have the fax number to the President of CIBC's assistant. I went through the normal complaint procedure with the NCO in Edmonton and got no resolution. I faxed my letter to the President, Mr. Gerald McCaughey this morning.
