I went to court in Alberta Court of Quuens Bench(June 27, 2006)and won!!! Fight for your rights and petition your discharge if your student loans have not been dismissed with your bankrutcy.
The judge wrote a stongly worded "nasty" letter to the Attorney General and sided with me.
Contact me if you like and will advise you. KMC

hey Kathy
Interesting
especially in Alberta
Has it been posted to the Canadian Legal Information Institute? In all the court cases I have read that have taken place over the last few years yours is a first and would set precedent depending on the surrounding facts.
I mean I have seen judges cut SL's in half, but totally discharge them? Don't mean to rain on your parade but I cannot imagine CSL letting that one go because of the implications for everyone elses SL's.
Sorry,....ever the downer.
Anyway I am glad you have yours sorted out to your satisfaction.

Congratulations! I wonder if this would work in Ontario? I would be definitely interested in how you managed to do this. I was discharged from my proposal last year and thats when CSL started harassing me, calling and asking the same questions over and over again, being totally unreasonable with repayment expectations. I know it would be possible and from reading this site the CSL office and Ontario Student Loans try to keep people ignorant of their rights.

Hi Kathy, could you please let me know more about how you begin this process, I am interested in taking the same type of action with my student loans also. I still have over $ 40,000 worth of student debt after my proposal, I would be very interested to talk with you more about how to begin the court process so I can put an end to this once and for all.
