Hi. I am having such a difficult time figuring out what the truth is on the ability of the CRA in collecting on what I thought was a stats barred Canada student loan.

I've read many places that they cannot take legal action or garnish my wages because I have not acknowledged or made any payments on my student loan since 2003, thus making it stats barred. However I've spoken on the phone to a local debts solutions (free)organization and I'm told that they don't need to take legal action and that there is no such thing as a crown debt being stats barred. That they can garnish my wages with no judgement or anything.

I do have a letter they sent in 2012 with a financial questionnaire and a note attached that says if I don't return it within ten days, the CRA will take "legal action" to recover the debt. That was over a year ago. I still have not acknowledged the debt and have not been garnished. The only thing I've received since that time are monthly statements which show that no payment have been made and my minimum payment due.

So, what's the truth? The guy are the debt solutions place told me to call them to make arrangements, but everywhere on the internet I'm told NOT to acknowledge the debt. I am lost and don't want to make any mistakes with this. PLEASE help me get a straight answer!!!

Woever told you that doesn't have a clue what they are talking about. Their advice will cause you trouble potentially. This is why you need an expert in this area. We (and any others you might find) are not frt ee though. Debt pooler's advice about these issues = you get what you pay for. 0.

The problem is you don't know if there is a limitation issue. from what you are describing it sounds like there may be one. However, there is a possibility that somehing occurred that suspenced the limitation period. There is only one way to know and that is to go inside and do a limitation discovery. This is not something you should do though. If you want to know what is what and where your safeguards are you are going to have to invest a bit of money to get this sort of job done.

Do you mean hire someone to do this for me? What kind of company does this? What kind of money are we talking about? I'd really like to know. I can't imagine that there would be anything that that suspended the limitation period as there have been $0 payments, and are stated as such on the monthly statement and I have spoken to absolutely no one EVER in the history of the loan. What types of things (examples) qualify as suspension of the limitation period?

Can anyone please tell me of a forum of information site which gives unconditional and educational advice?

Johnny is good at what he does and has permission to post here. The question you are asking and requires specialized knowledge and work to be resolved. Although considering Johnny's services is an option, hopefully some other people will respond so keep checking back. Unfortunately I don't know of any other forums as most experts don't give away their knowledge or services for free.

Forums are available to help you. I give advice as much as I can, FREE advice. You went to a credit counselor for advice. YOu are now here looking for advice. The reality is what you are looking for here is much more than advice. You want someone to "tell" you that your student loan is statute barred based on information that you are describing. It doesn't work that way. Limitation issues require investigation and a lot of analysis to determine. That is something I am not prepared to do for you here. That is a client service and you have to pay for that.

This forum is an information forum and I believe I answered your question in my initial response to you. If service is required then I offer it to people who require it. Perhaps contact an attorney and ask him or her for a freebie for you. Or contact a law society or provincial justice department and ask for advice, if you can somehow squeeze it out of them.

My last bit of advice to you is to pick an outcome and work with that. Contact them, waiver your legal rights, and repay it. Or, if you are in hardship and cannot pay it, seek a limitation issue as your best safeguard. If you need to know "how" to do this, come to me, or go to a lawyer.

If you are able to pay it but don't want to then that is not something that this forum can help you with.

Johnny has been helping me for some time now and my reasons for falling in the position that I am in were soo far out of my control. I called my creditors in the beginning explaining my situation and asking for help thinking that there was a program or some sort of help they could give but there wasn't. Everyone clawed into my bank account and took everything leaving me with soo many NSF fees that i couldn't buy food. It was brutal to discover that my creditors didn't care about the state they left me in. You think they would have a program that guides you from falling into default but they do t. They have a dead weight and a shackle and they will secure that to you at any cost. Trying tocht that thing off on your own is like trying to cut through titanium with a hack saw.

You wouldn't perform surgery on yourself or try to take on a room full of lawyers on your own, you would hire a professional to help you. Someone that knows what they are doing so you can go to living your life knowing that someone has things under control. That's what Johnny will do for you. He will get it sorted.
