I have a question that I really need the right answer. I live in Ontario and had a student loan that went into default. It went to ARC to be collected and they took me to court in 2006. I did not show up therefore they won Ina judgement against me. Then they took me to court for garnishment and got that. It was for just over $17000 and it was for scotia bank. As of last June 2012 it was paid off so my work stopped garnishing my wage. So i am thinking is all paid off at this point. Then in January 2013 ARC starts calling me again saying I owe $3000 in interest on the loan and they are going to start garnishing my washes again if I don't pay. They says ask family friends to borrow the money. I finished school in 2001. Do I really owe this money? And do i have to pay it? Can they garnish my wages again? I thought this was all over and put behind me. I also now own a house can they do anything with that?

I wonder what the ratio is for posters to people that do nothing and get gouged. For every one person that posts something there must be thousands with the same problem that just accept it unquestionably and get gouged.

You must have the document that says that you paid this debt in full right? If they are coming after you again for interest on the debt AND they haven't garnished your wages then it would be safe to assume that they are gouging you. They are probably using the old garnishment to scare you into thinking that they can garnish for this debt.

I would ask Johnny to see if he can sort it for you. He seems to be quite skilled at this sort of thing.

i loathe the system we live in more and more everyday...huge business, like hsbc banks getting fined 1.9 BILLION for laundering money for Mexican drug cartels, other business's being investigated for market manipulation of precious metals for MASSIVE profit..huge companies getting bail outs... CRA losing peoples information, over and over defaulting people, putting peoples privacy at risk...it goes on and on and on...

and i have to pay off my student loans with absolutely no systems out there to assist me? No way to reduce the debt once its defaulted? Sure you can pay off your debt for 15 years but do you think your credit will be fixed even HALFWAY through that time?  NO WAY...Do you think they're any systems out there to help you get into affordable living apartments once your credit is ruined? To help reduce financial stress to help pay off debts faster?  NOPE. Only rentals available to you is $900+ apartments NOT INCLUDING ANYTHING!!!!

"Whats that sir? Your broke, dont make alot of money (for the cost of living in the area )have bad credit and want to pay off your debts to move ahead in life, but you need an affordable place to live? BAHAHAHAAHAHA NO WAY!!! ALL I have to rent is this $1000 dollar a month basement apartment, hole in the wall with noisy neighbors upstairs and one furnace for the ENTIRE HOUSE, so its always freezing.

even the bankruptcy LICO is skewed and doesn't work right, how come the low income cutoff for a bachelor or 1 bedroom apartment is around $34 000 per year ( for low income single people) and bankruptcy LICO is $1980 per month?  How is it not provincially based or market based? or Based on rent or income or cost of living...or based on ANY RELEVANT at all????


1.5 weeks until I can finally declare my second bankruptcy and GET RID OF THESE F*CKIN LOANS FOREVER!!!

O btw Ive been off work for almost 2 weeks now with a severe back injury, and both of my bosses are just scrutinizing me and asking me why I went and submitted an WCB(workers compensation claim), and are being avoidant when WCB calls them to ask them about my claim... Gonna be out of money soon, and most likely not be able to pay bills next month.. GOOD TIMES EH!!!!!!?!!?!!?

Phone Conversation with my boss:

Boss: "UGH this doesn't happen to you all the time does it?"
-Me: "no.."
Boss"UGH you didn't start a WCB claim did you???",
-Me: "of course i filed it the first day i was injured..."

Boss: We would rather you just not start a WCB claim and take some time off work and we will pay you for the days you miss, as a WCB claim will make OUR RATES WILL GO UP....
-Me: Im not really sure the process, I havent been through this before, Im just looking out for myself as, my back is very sore"

Companies and bosses sure loook out for your well-being eh?  Not ONCE have I gotten a "get better soon, or get well, or hope your feeling better soon"

Im so sick of people, and this entire system...

If they had a wage attachment anchored in and it stopped at some point for whichever reason, and there is an unpaid amount in that judgment, then they can reinstate it, of course - as long as it is legal to do so. THE big question I have is why it stopped if there is still a balance to be collected.
 
You can contact the court and find out what the deal is easy enough. Do you still have the judgment papers and the prior statement of claim showing what they are pursuing?

The amount the garnishment was for is paid off. The problem is with the first judgment that hey have to get before the judgement for he garnishment does state the amount owing plus a certain percent in interest. I am assuming the the garnishment amount was a set amount because it had to be. The loan is from 2001 is there not a time frame in which they can collect? So at this point the amount is paid including interest at the time of he garnishment order the only money owing is he interest it accumulated over the 6 years it took me to pay the garnishment order. Is it not true a garnishment order runs out after 6 years unless they reapply which they can't because it is paid.and if try did take me back to court for a separate garnishment order would they be able to just for interest owing?

So this is interest accrual post judgment and recovery. Perhaps you should appeal to the head of GSLAC at Scotiabank and ask that they write it off. It is worth a shot ans see what they say.
 
They can only garnish for a certain amount of time I believe.
 
I would appeal to GSLAC and do it in writing, and write it without prejudice.

No I don't sorry. You just write to them and explain your position and appeal to them to forgive the interest that accrued during. 
 
Don't write anything that makes you appear bitter or angry. Their culture is dominant and if you come off sounding harsh it will undermine your own cause here.

He or she does that and CRA catches it and that could mean problems for the applicant.

There are a  LOT of organizations in the financial and governemnt community that are deeply affected (economically and productivity-wise) because people are able to find common answers to problems that the system inadvertently and intentionally creates for others.  You give an abusive person power and a pay cheque, what do you have?
