Hi everyone. I am dealing with CCA collection agency here in Toronto, ON. I have just gone on ODSP for emotional/mental stress. My monthly income is less than 800.00. I offered to send a monthly payment of 50.00 to the collection agency. They are going to talk to the bank (RBC) and get back to me to let me know if the bank will accept my proposed payment amount. My loans are all in default (I'm not proud of this fact) and I haven't made any payments for 10 years (again not proud of this fact).

I am stressed beyond belief and have been seriously contemplating suicide. I want to return to school and get trained for a career. I have a discharged bankruptcy but my student loans survived (!). I just want to pay what I can for as long as I can and consider applying to have my student loans discharged after I leave school and seven years has passed. Anyone experiencing a similar situation? Any advice/information greatly appreciated. Thanks.

DO NOT MAKE A PAYMENT UNTIL YOU GET MORE INFO HERE!!!!!

If you have not made payments in over 10 years your loans might be statute barred.  Talk to Johnny at CFW Group or wait for more guidance from here....and dont send them anything in writing either...

Making a payment would constitute acknowledging the loan and remove any ability to claim the loans are statute barred.

Thanks for the information Mark. According to the collection agency (Commercial Credit Adjusters Ltd.) my last recorded payment for my student loans was sometime in 2002.

I just contacted (via a helpful link from a member of CSD) lawyer Mark Silverthorn and purchased a cease and desist letter.

I want to do the right thing by my student loans but I am on a provincial (Ontario) disability pension and my monthly income is very low. All of my loans are in default (not proud of this) and it looks like I am not eligible for any government student loan relief programs.

Stressed to the maximum and feeling very hopeless right now.

I certainly hope the letter you bought doesn't make the admission that owuld disrupt limitations, if they are in place.

 Just found out my loans are not stats barred due to date of last time in school (one year ago). Johnny..... I really need your help! I'm terrified and can't eat properly, sleep is scarce and I feel like suicide is my only option (yes, it has come to that). I decided to act in good faith and I sent the collection agency a preauthorized withdrawal form. I want to make what payments I can. I don't want to be a deadbeat but I'm on ODSP (Ontario Disability Support Program) at the suggestion of my family doctor due to severe emotional stress. I did a little research and found out that I am considered to be 'creditor proof' because I am not earning a wage so therefore my ODSP cannot be garnisheed/etc. I chose to send a little payment because I want to do the right thing and act honourably. I don't want to talk to the collection agents. I can't deal with them anymore. I know you have a great reputation for helping as I've read the testimonials on this site and on CFW's site but I fear my situation may be beyond the scope of even someone with your abilities.

We're here to help and BTW, no one here thinks you are a deadbeat.  You tried to go to school in good faith.  It didnt work out financially.  Many of us have had difficult situations that did not allow us to pay back our loans even though we wanted to.  The problem is that there is little or no help for those who need it the most.  There are academic studies and articles clearly showing that.

Don't listen to the manipulative guilt crap that the collection agencies are putting you through.  You have a right to feed yourself and to take care of your self FIRST before the student loans. 

You need to disconnect from the collection agencies.  Talk to John, get advice from him or from here.  If the collection agency told you that the loans are not stats barred, don't believe them.  No one will actually tell you that they ARE stats barred, but the collection agencies are often caught lying.... because they are paid on commission....and they work really hard to suck money out of those who don't have it so they can get their commission before the end of the year.

If there is no payment in years, and if you did not apply to take out more loans when you went back to school, then going back to school would not likely have reset the stats barred clock.... but Johnny can confirm that.

There's help for you here. Many of use have been where you are now, but through support on this site, we find our way out and find hope.

If you haven't sent in the payment form, do not do so until you speak to Johnny.  I would recommend you cancel that withdrawal form immediately until you speak to Johnny. 

A payment would acknowledge the debt.  So try to cancel it first thing in the morning until you get proper advice.

Hi Mark! Thanks for your help. Unfortunately, it wasn't the collection agency that told me my stats barred status. I spoke to someone from the NSLC and they told me the last record they have of me as a student was just under a year ago (and they are correct).

This might sound strange but I am scared to contact Johnny. He has been very informative and helpful in his replies to my posts here but I can't get past the fact that I think I am beyond help/hope regardless of who I contact for help (and that is NOT a reflection of my opinion of Johnny at all-it's entirely my issue).

In a few months the only debt I will have is my massive student loan debt. I have a discharged bankruptcy (March 2003) on record. I applied for a credit card through my bank my they rejected my application (and I am actually thankful for that!).

I am planning on returning to school (no student loans of course!) to investigate an entirely different field of interest (thought I wanted to be a lawyer but have just decided that I'm not lawyer material). The job field I will potentially be entering is not a high paying job so I am potentially looking at another 2 1/2 years of school followed by 5 or 7 years of student loan repayment. I plan on investigating at the earliest opportunity the possibility of having a bankruptcy lawyer (trustees are not permitted to do this by law) file a hardship discharge application at 5 years after ceasing to be a ft or pt student. It appears that I will be at least 49 before I can think of applying to have my loans discharged (I'm 42). Discouraging to say the least.

Still trying to do the right thing. Still care about others.

HI Amiable1

NSLSC will also usually be mistaken (or lie) and tell people their loans are not stats barred.  Talk to Johnny at CFW Group.... he can determine this and you are not beyond hope or help.  The thing that really burns people out in these situations is trying to investigate all of this yourself.  Its really hard and frustrating work.  So call John and get someone advocating for you.   You need support in your corner.   

Hardship discharge might be an option under your previous bankruptcy..... let us know what you do,

You are thinking of options which is good....  and I can tell from your writing that you are intelligent and articulate.   You need to care for yourself too!
