Hi,

I went to Douglas College for a year in 1994. I was pretty young <20. I never really made anything of myself since then and have had sporadic periods of employment.

I have not worked since 2007, but instead have raised my kids while my wife has worked.

A long time ago any sign of these debts dissapeared from my credit report, however whenever I have had a tax return monies have been taken by HRSDC. They still send me a notice every single month for almost two decades. Just by the monies they have taken from me they have at least had that debt paid off. It has goen way down and the climbed way back up due to interest. 18 years is a long time.

I am in a position to go bankrupt, but not having worked in the last 5 years I am almost at the point any current debts have become stats barred anyway and a bankruptcy would just sit on my report from several more years.

At no time have I talked on the phone or even put something in writing acknowledging any debt.

I am having a really hard time getting out from under this debt.

What is my best choice of action here?

Bankrupty or Stats Barred and does a Student Loan dissappear during either?

Bankruptcy will also cause the student loan to survive any current limitations in the event that the student loan provider(s) oppose the discharge and are successful in doing so.

The bottom line here is if you gamble with bankruptcy and it is a success then the student loan is removed. If it is statute barred and you really cannot pay it then there is no reason to risk bankruptcy.
