Subject: Administrative Oversight...now what???

I have been battling having a mistake fixed by the nslc for almost seven years.  My loan was placed into collections after a call where I was requesting interest only payments and not interest free.  They sent the interest free and from that is where my nightmare began.

I have filed two appeals with the Canada Student Loan Program without success.  The last letter I received states that they had infact made an administrative oversight on my account.

When I started the process of making appeals I was told that if an error any kind was found, my loan would return to the state it was in at the time of the error.  The first appeal responded with saying there was no oversight however if I paid 5000.00 in interest they grant me assistance with repayments plans as my financial situation now qualifies for that.  I argued that as their mistake had already wrecked my credit and had my loans bounce around for years, while I made payments, that that was not fair.  I  continued to argue that there was a mistake.

After a second appeal and 67 pages of documentation, including correspondence sent to me by the nscl, I was told that an administrative oversight had occurred however as I already had the chance to pay up the interest there was no further option.

In 2007 I had the nscl send me all their copies of correspondence which included documentation of me calling immediately when I received the wrong contract as well as direction that tells the reps not to talk to me and to ignore my calls.

I have talked to my MP about this and he thinks that I should pay and not try and right this wrong.
I feel I should pay my loans however feel that I would not be in this situation providing the initial mistake was not made.  I have continued to put money on my loans however as they move around the interest piles up.  As well when the first investigation happened, it took 9 months of the nscl to tell me that I needed to pay the approximate $5000.00 in interest and during that 9 months, they would not accept payment.

The question is where do I go from here?

Please help

You have documented evidence of this?

Unfortunately I do.  i believe the exact wording was if customer call ignore customer.  I just wish I had some direction about what to do now.

Hi Johnny, we connected, spoke on telephone and I sent you personal documentation as you requested. You said I would hear from you and I didn't. I tried calling and left messages. What happened?

I have been in the U.S. on business. I am back on February 4th.

I told you the best way to reach me in any event is through email.  If you need to talk by telephone, you can email Heather or I and you schedule an appointment. Calling randomly is more miss than hit, which I advised you of.
You have my private email address. This quickest way to reach us: http://www.cfwgroup.ca/index.phpoption=com_contact&view=contact&id=2&Itemid=157" rel="nofollow - http://www.cfwgroup.ca/index.phpoption=com_contact&view=contact&id=2&Itemid=157

There must be some confusion, as you and I talked in the telephone and you have me your number. It is in the past and honestly was another let down that I was used to. When we talked it was in 2011. You were supposed to call me and didn't and I left messages on the telephone number you have me. Who is heather? Thanks for your advice, fingers crossed the minister of hrsdc can help.

There's a typo in the link you've provided, Johnny.  A missing "?" after ".php". Here's the correction.

I met with my MP yesterday and discussed asking for a Minister review with the HRSDC. The question I'm faced with is what can I request for outcomes when it comes to my loan? Will they offer any loan forgiveness as compensation? Can they? The process has been going on for so long and so much interest has accumulated what exactly are the options?

I doubt they will forgive your loan based on an error being made. You can ask, that is for sure. If they did forgive the loan then they would have to forgive half of the loans out in that sea of debt. The minister can do anything so it is up to that office.

I would ask to only have to pay the principal.

That's what I was thinking as well. I was told by my that there was only so much the minister could do and that by asking for something in their limitations, I was more likely to get it.

You can see what the dutie4s, responsibilities, and the powers are in the legislation. Canada student loans financial assistance Act and the CLSA.
