Hi all.

I've been looking around trying to find info on defaulted loans and such ans haven't had much luck.

I had 2 loans from 2000-02. I graduated in 02. After so, my payments were way to much and I was not able to find work in my field of study and I was only making min. wage at the time and unable to pay like a lot of people.

Since then. The good ol CDN government takes my tax returns because of this.. Not sure about this year.. yet.. but no doubt...

I used to get letters from the government showing what I owed and the min. payment with a payment stub attached.

I was over paid on EI the other year as they screwed up and that was also on this statement with the loan. My last 2-3 statements have not had my Loan on there just the overpayment.

Is it possible that it has been cleared under some of these new laws and stuff that I have seen floating around? Or possibly the government just getting my hopes up that this monkey on my back is taking a break.

There are only three ways to get a lien lifted:

1) Having the ability dfeomstrate hardship with extenuating circumstances
2) Limitation issues are in place
3) Pay it out

what I was wondering, where I haven't got any kind of statement about the loan in months if it is now "gone" since it has been over 10 years and such. Guess i'll find out in a few weeks with my taxes filed

If the limitations have been met (reason #2 to lift a lien), does the loan holder have to bring this to someone's attention?  The CRA is still taking my tax refunds and my loan has been dorment since '98.  I made all of my payments for the first 2 years of my loan (96-97).   

They've been taking my income tax for the past 3 years (as the only income provider with 3 dependents my refunds are around $3000 a year).  According to my "statement of account" on the CRA "my account" section, the refunds are being applied to my Ontario Student Loan.  I had a small CSL too - which is equally as old.  Should I expect that they start applying my refunds to that next?
