Hell ,

My 10 years limitations has passed 3 months ago. My student loan was not included in my bankcruptcy when I filled it 2001. Anybody know the procedure to ask the court to discharge my student loan ?

My original was 50.000 and I bring it down to 38000 now....but I am still having a hardship

I talked to my trustee, but he could not offer me a help ....

Please help me....  I am in Toronto

I called my trustee with this very question.  He told me I would have to file bankruptcy all over again.

Of course - he gets another $1500 or so out of you, and if you can't prove hardship (i.e. you NEVER will be able to repay sometime between now and the second coming) your student loan may not be discharged even after 10 years (now 7?).

Face it folks. The bankruptcy trustee(s) is in it for the cash - and nothing but. Otherwise, they would do something to really help you out. They preachthat they are there to help you. But if you ask for help that makes them work, or could somehow expose their ineffectiveness, this is what you get.

there is at least supposed to be a procedure wherebyyou can apply to have your student loans included in your banklruptcy once the 10 year limit has passed.  whether this is still true I dont know.  What will happen if and when the C-55 changes come into effect is sheer speculation.  at least in terms of people who went under prior to its passing who did not have their student loans included in their bankrutpcies and havent reached the 10-year moratorium yet.
