I'm looking for clarification about my CSL and my bankruptcy.
I filed for bankruptcy in 1997 (prior to November/97) and was discharged in early 1998 (prior to June/98). My CSL were included in the bankruptcy (the main reason I declared bankruptcy!) and my understanding was that they were "gone" when discharged.
I have recently obtained a credit report and found that one of my loans is still listed. They list the "high credit/credit limit" as $7,140 and the balance owing as $2,936 (I didn't pay that must on it before defaulting). The last date of activity is 10/99 (no activity on my part that I can figure out). It says on the comment line on the credit report that it is "included in bankruptcy, student loan". On advice - which I am now thinking was very poor advice after reading some of the posts here - I called CIBC, as the credit bureau said that only the bank could fix the mistake on my credit report. I am now afraid that I may have unknowingly "acknowledged" this debit. I thought it was just a mistake, not knowing anything about the 2 and 10 years rule changes made in 1997 & 1998. I hope that's not the case. I didn't actually talk to woman in charge of my account but did leave a message.
My main question is what rule does my bankruptcy fall under? Did it fall under the BIA that was in force when I filed (that it should have been treated like all other consumer debit), or when it was discharged (the 2 year rule)? And does the rule change if I took a class at university after the date of discharge (even if that course was non-credit)? What do I have to do to get it off my credit report?
