I just find it very funny that I would get a letter post mark in the city I live in, but the lawyer is from Edmonton, Alberta????

They are demanding and immediate payment for the full amount or they may consider taking me to court. But I have been making payments, although not very ,much.
Because of other financial disasters since my seperation in 2002, I am seriously considering bankruptcy to start a new slate. I graduated in 98 and my ten years will soon be up.

This is a scare tactic. Gold has no jurisdiction in NB from Alberta.
Continue making your payments and let these fear installation tactics simply absorb - and pass. If you feel that you cannot deal with it, or become overwhelmed with worry, come to me and I will take care of this minor nuisance for you.

Yes there are rules.
In this case, especially.
In this particular case, it would be impossible for the agency to obtain a judgment in NB due to provincial laws - and even if there were an avenue, the liklihood of Gold suing someone in NB would still be an impossible feat.
In this case, they'll find Jimmy Hoffa before they will a judgment.

If I were being taken to court....by the provincial/federal gov.???... would it not have to be through the local court house ....close to where I reside??

They could . . , but it would have to be monetarily worth it. It
usually requires someone (hired) to do the legwork in the other
province, and many of these cases are small claims sized. It's a
question of being worth it. For millions it'd be worth it!

The letter is not even sogned by this guy...just a line in the signature block!
Unfortunatly I had dealings with Ms. Reid already and had informed them to stop contacting me at work and only through letters as I would file a complaint against them with HRDC and Consumer Affairs. The phone calls stopped. Ms. Reid was one of the CA's that belittled me supporting my children instead of paying my student loan. I pay what I can when I can that's the thing, so it's not like I'm trying to hide.
I did let them know to proceed with the legal action because I found it very unlikely that a judge looking into my situation would order that I stop paying my support for the children in favor for the CSL. I'm not so much fearfull of court but most annoyed by the harrassment and vile behavior by them.

HRDC has nothing to do with this issue because it is the RBC you owe. It is not a "Crowned" loan, or a CSL.
The letter you have shown is nothing but a scare tactic. If you call the collector and tell her that you know this is a scare tactic, she will deny, grobble, and battle to think of something else to reinforce the issue to make you "believe" otherwise. This is a traditional fear installation tactic.
If you cannot handle this, and feel too overwhelmed, let me know and I will contact Gold (and NCO) on your behalf to address it - and elimintate this toxic effort to intimidate you.

Sorry to hear about your grief with your student loan. Just want to address some of your concerns.
1 - As long as you are making payments, even if it isn't the amount
that is expected, no lawer will succeed if they take you to court.
2 - I serously doubt there is a judge in the province that would force you to put Student Loans over yoru own children.
3 - Before considering bankuptcy, talk to a lawyer who is familiar with student loans and bankruptcies.
4 - I am not a lawyer but I do know that the Alberta courts do have
some jurisdiction outside Alberta. (I know this because I
successfully sued someone in British Columbia through Alberta Small
Claims Court.) However, your matter is with a national company
(Royal Bank) which does do business in NB. It is simply not worth
it for Gold to sue you from Alberta.
5 - You mentioend that the letter to you from Gold is not signed.
In my world, no signature means the letter doesn't exist. I am
pretty sure the courts would agree with me on that. If Gold isn't
willing to put his signature to something then he is not willing to
back it. Proof to me that this is merelly a scare tactic.
Someone is hoping you will cave if you see a document from a lawyer.
6 - It is my experience that collection agencies rarely put a proper
signature on any mailing. (A name in italics at the bottom like
RBC does on some communications doesn't count.) If I am having
problems with a collector I always demand WRITTEN notice with a
SIGNATURE and I stress that no signature means nothing was sent.
This is a good way to help keep things honest.
7 - Whever you have a problem with Student Loans or any other creditor,
KEEP A DIARY. Keep track of EVERY call, letter, and who you
communicate with.
8 - Buy an aswering machine that can record phone conversations.
Record every conversation with a collector or Student Loan.
Recording a telephone conversation is legal as long as ONE person (i.e.
YOU) know the call is being recorded.
9 - Don't be afraid to be agressive with collectors. Practise
saying, "I will need that in writing, with a SIGNATURE." :)

This question is for Johnny or Mark .... I live in Alberta. My Canada Student Loan (bank risk - Scotiabank) was taken out in Newfoundland. I got a letter today similar to the one described here from the same R Max Gold. However, the letterhead states that he is in Surrey, BC but the letter says that he is a member of the Alberta Law Society. Given I live in Alberta, would this letter be more than merely just a scare tactic?

That is NCO's lawyer. I don't know if it is a scare tactic or not. You should contact the loan provider that they say you owe and confirm if their permission to proceed this way has been granted.

I received a letter from the NCO in Alberta stating that my account has been forwarded to Mr. Gold. I live in B.C., does he have any juristiction there? Is this just a scare tactic as well? I have a chronic illness and can't handle the stress this is causing me...
I would like to speak with you. I called the number and I got a woman's voicemail. Do you still work at CFW?
I too received abhorent treatment from the SUPERVISOR of student loan collections. His name is Justin Thibeault. He was yelling at me so loud I was holding the phone away from my ear and I could still hear him.
I submitted a complaint against him and NCO with the CIBC National Collections Centre. IF anyone else has received horrible treatment by NCO and it was for a CIBC student loan, let me know and I will give you the number to submit a complaint.

I registered the initial complaint with Alison Grimmond and then I spoke with her supervisor Winston yesterday.
I did call your assistant Terri today. I got some information about what you do at CFW.
The thing is that my letter was dated Aug. 15, I have to get back to them in 10 days. That's the 25th, unless I don't have to count the weekends, at least not Sundays. That would buy me four more days.

This address belongs to the collection agency NCO Financial in Edmonton. That means he works for NCO Financial. In-house legal counsel is what they call it. I wonder if he has any other clients besides NCO, since he is operating right out of their office? NCO is not a law firm.
Please give us the scoop.

He is definitely a solicitor and he does work for all the major financial institutes in Canada. To the best of my knowledge he specializes in bank collection recovery. He is an independent solicitor and does not work for the collection agency

I have been speaking with Winston, Alison's supervisor. He said he reviewed my case with a relationship officer and they found no reason to stop the judgement from happening. This is even though I had only ONE contact with NCO, and that was the abusive conversation with the "supervisor" at NCO. I never got a letter from them at my new address here in BC (I moved here from Ontario in May). The only reason I contacted the NCO in the first place was because they called my mom's house and she forwarded the message to me that they called. I knew why they were calling me and called them to update my address so they could send me a letter. I got threatened, mocked and abused instead.
Apparently the only reason why they are seeking judgement is because I sent a cease and desist letter. I did this because of the way I was treated on the phone.
I'm also going to find a lawyer that works on contingency because I'm looking to hold Justin Thibeault accountable for the way he treated me. I was so upset I could barely function the next day at work.
I'm really disappointed that CIBC National Collection Centre did not see a reason to stop this judgement, even though I was treated really badly by NCO and NCO told them they tried different avenues before they got my cease and desist letter. That last claim is blatantly false.

What you should do is escalate your complaint to the presdent's office. If the collection agency has good reason to sue, then they will always take that approach (providing t is cost effective).
One thing that collectors don;t lke is when you confront them, and try to gain the upper hand. What you should do is contact the President's office in writng and ask them to intervene. Write out exactly what took place and send it to them.

Wasn't questioning whether or not he is a solicitor. What I am wondering is why is his business address NCO Financial System's in Edmonton? He is there unique in-house counsel. Anyway, what is your predicament with student loans anyway?

I just realized yesterday that NCO broke British Columbia collections laws by phoning me before they sent me a letter here in B.C.

If you have been violated or mistreated in any, you have to go to the source. The loan provider. The president's office is where you may ant to consider escalating your grievance.
