Hey everyone.

It feels good to know that I'm not the only one in a bad situation here.

Here's what happenned to me in the past month.

I receive a letter from Collect Corp saying that I needed to call them back...  I didn't get the chance to because they called me the night I received the letter.  The woman, Miss Edwards was really not in a good mood.  She told me I had to pay the whole thing in the next days and if not...she would take me to court.  You see, I've been a single mother, providing for my little girl, all by myself, for the past 3 years and I couldn't pay my student loan before.  Now I can, but she won't let me.  She told me that my priorities weren't at the right place, that my daughter wasn't important, the important thing was that I pay my loan right now.  She also told me that if I didn't do so, she would call my boss and tell him that I wasn't paying my bills...

She then told me to call a bank or a friend....and so on..to find the money... to shut her up, I said I would, and I did, but I need a co-signer to have the money and there is nobody in my familly that can do so.  So I told her, after my confirmation, that it wasn't an option.   I don't know if you notice here, but this lady made 3 big illegal things in a simple little phone call.  That's really bad for them.   She was so cruel, making personal attacks about my way of dealing with thing, my responsibilities, and my daughter that she made me cry.  They can be firm, but they don't have the right to be abusive like she was.

I got another call from a lady, probably working with Miss Edward because I could ear her in the back... she called, in a conference call my representative at the bank, without my approbation and his, and she asked us to discuss about my account there.  Big NO NO... I had to call him back because he didn't know what was going on.  He though he was in trouble.

You see, what these two ladies just did is against the law.  We have rights.  According to HRDC, they are not allowed to pressure us into getting a loan to pay off this one.  It is illegal to ask information about someone's bank account and to talk to their bank representative.  It is also illegal to talk to someone the way they did.  And as for taking me to court, I've been to that agency for only a month and I do want to pay...but I can't pay all at the same time and according to HRDC again, they HAVE to accept payments.  

You know, these people can really get in trouble for doing what they just did.  And to many times people just let it go by and do nothing about it.   Well not me.  I called up my lawyer and asked him for advice.  He told me that I had to right down a complaint and call them up by phone, after that, fax them the letter.  You also have the right to ask that all futur communications be made by mail only.  You have to get that in writting and send that over.  It is also stated by HRDC that you can do so.

So I did, and I also confirmed them again, for the million time how much I was willing to pay each month and asked for a confirmation letter from their part before I send the money orders. 

You know, I just hope I did the right thing.....

Being educated about this type of stuff is the best thing.  Many people panic or don't complain because they are not educated about these issues.  You have done the right thing.

Emma,

The way you were treated is uncalled for!!  A gal from Total Credit Recovery treated me the same way--attacking me personally about my responsibilities and lack of maturity as an adult in the matter. I'm so glad for this support team here who guided me through the steps necessary to take back the power--like you have--good for you

I had a good  chuckle one day when I asked the gal (for lack of better or worse words) to not speak to me like she was.  Her come back was, "What do you expect, this is not customer service".  It was a good laugh anyways .

Kwel,

You wont believe this, I got the same line from a CA at CBCL. I told her that if that maybe they would have better luck collecting more debt if they wouldn't treat people like petulant children. To which she replied.

"This is not about customer service. This about you meeting your financial obligations"

They must all work from the same script. I'm sure they will run out of boilerplate language if you keep them on the phone long enough.

They really need to change their scripts, eh!!  Did they ever think that acting with a little respect would get them a whole lot closer to their goal...it would work with me...I would have at least tried to find something to send.  But, then again, when you have nothing--it's hard to scrap even that up.   But, things are different for me now--thank goodness!!

whoops. Plus, their masters wouldn't let them express free will over the phone anyway for fear of saying something stupid.

How comical. I applied this keep 'em on the line tactic over a consumer credit issue [courtesy of partners in credit.]

I think everyone would feel a little more relief if they tried this. Obviously we're all aware of our fiscal responsibilities... knowing you can toy with these crazy CAs brings a world of relief and hilarity.

ya, my dad just told me that credit corp had called my home a few days earlier and said they need to speak to me because 'it is a very serious matter and the federal government is involved'

my dad thought it was the FBI

pisses me off so much

The FBI!!!  That's hilarious!   .  My partner pretends to be their best friend and give them a comforting shoulder, has nice chats with them while I'm sitting downstairs watching tv (a.ka. not in the house, not sure when I'll be back).  He get's a good laugh out of it.

Collect Corp.  frightened my mother into beleiving that that I could be stopped at the Canadian border and arrested for having left the country.  She says they were very rude and abusive to her.  They have kept calling my parents home even though they have nothing to do with my loans and even though my correct contact information has been provided to collect corp.  They've made all those threats about being able to get the money from my bank account without my consent, contacting my place of work, etc.  My parents now know that they do not need to take it and they do not need to talk to the collectors at all.  They've tried to get my work number from my partner as well.  He knows better than to give it. 

When I have the money or when they want to deal lawfully and honorably with me, I'll talk to them.

hey i allince one aske me said who ur bank named them all off i said i am not telling u she said u have too i need it i need it now i said too bad 4 u i aint giving it u will send me no documents. and 3 weeks ago still calling the old place i used to live at threatening old roomates 4 them to pay i called them said on answering machine to send all info to mailing add they havent i said i have talked to an executive correspondant for prime minister and to whom i go to to get loan back from but to send all what they have on me and they never have n i asked from day 1 they sent me a cheesy form...with totaly wrong dates.
