I've been struggling with the concept of using the 10 year rule.  I have been out of school since April of '94.  I went bankrupt in 2000.  I know that I would probably qualify to have my debt included in my bankruptcy of 2000.  But here is my dilemma.  Earlier this year, my husband won a settlement.....with which he used the money to pay off his debts and buy us a house, truck, and a few toys for himself (boys and their toys, lol)  Now the money is obviously gone, but we have no debts (just MY CSL, and it wasn't his debt to pay, but mine)

1.Would including my csl on my bankruptcy hurt his assets in any way?

2. Will they look at the fact that my husband got a settlement, so why didn't we pay off my CSL?

3. Will the fact that my name is on the house too hurt me?

4. If I can have my CSL included on the bankruptcy, how does it sit in my credit report?  Does it show as still owing it?  If so for how long?

Once I get these things figured out....if it's in my best interest......I would definately have my CSL included, and you can bet I would hire Johnny to do it.  But I need some peace of mind, cause I don't want to hurt my husband in the process.  Or our house.  Any ideas?
