This website is a testimony to the problems Canadian Student Loan borrowers experienced from approximately 1996 to 2008 and until their loans were paid off.

The privatization of the Student Loans system by the Chretien and Martin Liberal governments broke the system and defaulted thousands of borrowers who were trying to pay their loans. There were even stories of suicide due to the harassment of borrowers.

Canada Student Loans-The Need for Change Fortunately the new Conservative government at the time revamped the program and fixed the system for new borrowers, but borrowers under the previous program were left with ruined credit and continued harassment from debt collectors.

I call on the Canadian Government to apologize to the borrowers affected by this fiasco and make amends.

Unfortunately the Liberal government is again clobbering the Education system with their changes to International Student Visas. Yes, there's a problem, but instead of a well thought out plan, they have pulled the emergency brake on the train causing a derailment. This has introduced unprecedented instability for both private and public education institutions who serve both international and local students.

Universities have been forced to cancel programs and layoff hundreds if not thousands of full-time and contract instructors.

Again, the Liberal government has messed up the education environment.

I ended my studies in 1994.  In 1998 I filed a Consumer Proposal, and it was discharged in 2000.  My student loan went into default, and Nordon was after me for a couple of years with different people calling and different types of letters being sent.  I did not make any additional payments on my student loan after filing my Consumer Proposal.
 
The calls from Nordon ceased for a few years but started up again last year.  Again I ignored them, assuming it was past the date of absolution.  Just last week I discovered that in June 2009 Nordon filed their collections claim with the credit bureau, and the amount how appears on my credit profile for the first time in over 10 years. 
 
Is this legitimate?  Can I not contact Equifax and dispute that the collections report is being filed well past the date it should have appeared?  Had it appeared on my file back in 1998 when I filed the Consumer Proposal it would have been removed in 2005, would it not?

A student loan would only be cleared in a proposal if it was included in the proposal and it had been 10 years since you were out of school when you filed the proposal.... so the loans would survive the proposal.  the other thing is to check the date that the new 10 year rule came into effect... it may not have been in effect when you filed.   Best to check with your trustee...

I finished my studies in 2001 and filed my proposal, which included my student loans, in 2005.  I am assuming this means that the remainder of my loans are still there after my proposal finishes in 2010?  What is most likely to happen, the lending institution will come knocking or a collection agency?  What can I do to prepare so that I am not hit over the head with this in June 2010?  Thanks for any advice!

The laws have changed since you filed your proposal... best to check with your trustee.... the 10 yaer rule was changed to 7 with a hardship hearing available after 5.  Also, did you file before the new laws came into effect in I think it was  1998 or after?

When did you make your proposal in 1998.  If it was before June 18, 1998, you are subject to a 2 not 10 year rule.  You would have been out of school for 2 years as you ended your studies in 1994.  If you went after that date, you would have been subject to the 10 year rule.   You are eligible to make an application for hardship relief now as you have been out of school for 5 years.  If you qualify for hardship relief, the relief is subject to the date your certificate of full performance was issued.

Your certificate of full performance will be issued in 2010.  You were not out of school 7 years (used to be 10 years) at the date you made the proposal.  Your loans will be revived upon the discharge of the TRUSTEE.  Your creditors can't do anything until then.  That gives you some breathing time. As well, you can make an application for hardship relief under s. 178 1.1 if you meet the criteria. Otherwise, make arrangements on your terms.
