This website is a testimony to the problems Canadian Student Loan borrowers experienced from approximately 1996 to 2008 and until their loans were paid off.

The privatization of the Student Loans system by the Chretien and Martin Liberal governments broke the system and defaulted thousands of borrowers who were trying to pay their loans. There were even stories of suicide due to the harassment of borrowers.

Canada Student Loans-The Need for Change Fortunately the new Conservative government at the time revamped the program and fixed the system for new borrowers, but borrowers under the previous program were left with ruined credit and continued harassment from debt collectors.

I call on the Canadian Government to apologize to the borrowers affected by this fiasco and make amends.

Unfortunately the Liberal government is again clobbering the Education system with their changes to International Student Visas. Yes, there's a problem, but instead of a well thought out plan, they have pulled the emergency brake on the train causing a derailment. This has introduced unprecedented instability for both private and public education institutions who serve both international and local students.

Universities have been forced to cancel programs and layoff hundreds if not thousands of full-time and contract instructors.

Again, the Liberal government has messed up the education environment.

So here is my story. I have a CSL from CIBC in the amount of about $7700. I was making payments on it through Toronto Credit Counseling. I lost my job in December 2003. From then until now I have not made any payments. I moved in the summer of 2004. So they did not have my new contact info. Just last week I got a call from a Mrs. Edwards of Collectcorp. She was very aggressive and asked a lot of questions. She told me I have to pay the full amount owing by last Friday. I told her that was not possible. She said the regular collector BS that I should get a loan or borrow from my parents and friends. I told her it is not going to happen. She said I have been avoiding her for a very long time and that they will start garnishing my wages.

 

I told her that I willing and want to go on a monthly payment. She told me that is not an option. I asked her what other options do I have. She then transferred me to another guy who told me that he is willing to help me out. He said I will have to make an initial payment of $2000 within a week and then they will workout a payment plan for me. He asked me to give him a fax number where he will fax me the paperwork. I told him I would get back to him in the next two days.

 

Then I found this site. It is awesome. So over a week has gone by and I have not contacted them. Mrs. Edwards has been calling me regularly since then. I have been ignoring her. My mom tells her that I’m not home and lets me know that she called. Mrs. Edwards emailed me asking me to call her at her number. I gave her my email address in our initial conversation.

 

I don’t want her to call my house anymore. More importantly I don’t want her to find out where I work and start calling me at work. I have a stable job now. I want to start paying $300/mth starting February. I can make a payment of $100 on Friday Jan. 28 and then $150 biweekly from then on. I can even foresee me increasing the payment in the next few months, as my financial situation gets better.

 

So I need advise from you guys. What should I do and how should I go about it. Who should I make the payment to etc? What should I do if they don’t agree to my offer? Thanks for your help.

i would go to cibc and make a payment.  explain things to them, tell them you are now employed and wish to resume making payments.  let them know that you are unhappy with mrs edwards and her refusal to accept a payment arrangement from you, and her good cop/bad cop line of crap tactics.  cibc will gladly take your payments and the CA will have to wait that much longer for their commission.  ask if it is possible for them to recall your loan from the CA.  you may have to jump through some hoops, but it never hurts to ask.

as for the old "you have to pay us a million dollars right now" routine, its simply a matter of wanting a big commission ( the end of the month is approaching) and making you feel the need to do whatever you can to pay them off right away so they get more commision with less effort.  read some of johnny's posts regarding the tenderizing techniques frequently utilized by the CA's.

read through some of the other posts.  there is much knowledge here to be shared.  if you are still uncomfortable dealing with this situation, i would suggest you call or email johnny if you would like him to run interference for you with the CA.  there is a cost for his services, but he is well worth it.

Call up cibc student loan centre and let them know she's emailing.  Even if you give the address, that is against their policy!!!

So here the update:

 

I called CIBC student loan center. I asked them for my loan account number and the total amount so I can start making payment. She told me she does not have that info since the account is forwarded to a collection agency. She told me that I have to contact the collection agency to get that info. I told her that I don’t want to deal with Collectcorp. I want to deal with CIBC. I told her I just want my account info so I can go to a CIBC branch and start making payments. She told me that they will accept my payment and that I have to make arrangements with Collectcorp. I pushed her to give me the info. She put me on hold and to talk to someone else. Then she came back on the phone and said there is nothing that they can do for me. I will have to contact Collectcorp. I told her that was ridiculous and said bye.

 

Then I called Collectcorp and spoke with Mrs. Edwards the lady who’s been call me. I told her that I want to start making payments and need my CIBC account number and the total owed. She asked me for a fax number so she can fax me an agreement for me to pay a sum off $6500 and close the account. I told her that is not an option and again asked her to give me the info. She then transferred me to a lady called Ms. Wallace who told me she was the collections manager. I told her I want to start making payments so I need my account info. She asked if I was okay with the statement that she has come up for me ($6500). I told her that was not an option. She then started with collector BS of get a loan or borrow it from a parents or friend. I told her I tried and that was not an option. She told me that they would have to move ahead with legal action. I told her it is a Canada Student Loan that I have and only HRDC can take legal action. She laughed and told me that she didn’t know what I was talking about.

 

She finally gave me the CIBC account number and that total I owe. She told me she would not authorize any payment other than the settlement that they have come up with. Either $6500 in total or $2000 down and monthly payments. She asked me for the name of the bank that I bank with. I told her that was not relevant. She told me that she would not accept monthly payment because I haven’t paid in over a year and I can’t be trusted. She also said that she would be sending me a letter in the mail.

 

So what should I do now? Should I go to CIBC and start with my payments? Thanks for help guys. This site has empowered me and I don’t feel any fear now when I talk to these jokers.

 Here is the real controversial stance on this one...

 You owe CIBC the student loan. You do not owe the colleciton agency the money. The collection agency is only there to manage and collect the debt FOR the CIBC.

 when the CIBC tells people that they cannot make arrangements - and in order to make payments you must call the collection agency to do so ... that speaks a thousand words about their self-proclaimed above average customer service and quality assurance.

 The bank is telling you this because they do not want to get involved by hindering the collection agency from doing their "thing" to collect the debt. If anything happens to you that causes problems in any way, the bank can then blame it on the agency so they come out smelling like roses. This is the system and how it works.

 If you would like help. let me know. I can turn this around for you - and put it into a more palatable, productive, manageable, and peacful matter.

Coupla things:

They can't refuse a payment; they can only refuse to accept an agreement that absolves you from a requirement to pay the full past-due amount. Therefore they will NEVER tell you that an arrangement is acceptable even though they will cheerfully process your payments and collect their commission.

So. Send in your payments using postal money orders.

If you want to give them postdated cheques, open a new account at an institution that you use for nothing else at all.

Give them no information concerning your employment or even anything that seems irrelevant. Send them a registered letter insisting that all communications are to be in writing at an address (preferably a PO Box) that you provide. In the letter, you might want to include a statement as to what payments you will be making and when. CC the letter to the bank and to the Ministry responsible in your province for overseeing collection practices. Respond to or acknowledge written communications from them; that way they can't claim that they had to call you at home or at work because they didn't have an effective address. But do not provide any personal information or fill out financial statements when they insist you do so.

Get a tape recorder and attachment and record and log any calls that you might receive. Maintain records and keep copies of everything.

Once you've done all that, the control is back in your hands. They will not sue for non-compliance as long as the payments are being made, so you have breathing room. You should be free from harrassment calls. At that point you can start making decisions as to what you want to do in order to retire this debt.

whci98...You handled things so far with great class. Brilliant. If they handed out collection agency advice at convocation along with our degrees, I wonder how long it would be before they would have to start reevaluating their traditional statics...I mean they pull crap coz it WORKS, right?

Oh my, I've also had the misfortune of dealing with this Ms. Edwards as well.  She is really unbelievable.  I had the pleasure of dealing with her associate Mr. Bersuchi (not sure how to spell that) as well.  They are really disgusting.  They basically threatened everything but coming over to break my legs.  I really think something needs to be done about this Collectcorp place.  I was in disbelief at the things that were said to me.  I honestly do not know how these people can live with themselves...I'd rather be homeless on the street than ever do such a job.  I hope Ms. Edwards and her ilk someday get back what they've given....
