This website is a testimony to the problems Canadian Student Loan borrowers experienced from approximately 1996 to 2008 and until their loans were paid off.

The privatization of the Student Loans system by the Chretien and Martin Liberal governments broke the system and defaulted thousands of borrowers who were trying to pay their loans. There were even stories of suicide due to the harassment of borrowers.

Canada Student Loans-The Need for Change Fortunately the new Conservative government at the time revamped the program and fixed the system for new borrowers, but borrowers under the previous program were left with ruined credit and continued harassment from debt collectors.

I call on the Canadian Government to apologize to the borrowers affected by this fiasco and make amends.

Unfortunately the Liberal government is again clobbering the Education system with their changes to International Student Visas. Yes, there's a problem, but instead of a well thought out plan, they have pulled the emergency brake on the train causing a derailment. This has introduced unprecedented instability for both private and public education institutions who serve both international and local students.

Universities have been forced to cancel programs and layoff hundreds if not thousands of full-time and contract instructors.

Again, the Liberal government has messed up the education environment.

So...wondering if this has happened to anyone else, and if you have any advice to share with me.
 
Last week I recieved a letter from HRSDC claiming that I owed them 600 bucks...hmmm why would I owe money to HRSDC?  After finally finding on the paper what this debt was for...CSL, I placed a phone call to tricura/CSL. As it turns out I had been sent to collections to Revenue Canada for unpaid student loans...BUT...Tricura/CSL and myself have proof that I have made all required payments to student loans, completed all Master agreements that I have been requested to do. ( I only pay the interest on the loans at this point because I make too much to qualify for interest relief but not enough to pay the entire payment) So I get told " I am so sorry Mrs. Barber there seems to be some administrative mistake here, you should have never been sent to collections. I will be sending in a recall to have your loans brought back to us" Apparently CSL sends you to collections after they have not been able to contact you for 270 days or have not recieved any kind of payment from you in the same amout of time. I am in contact with CSL at least every 6 months. Anyways.. fine and dandy please get the loans recalled back to your office as this was no fault of my own. 10 minutes later I call Revenue Canada to find out the status of my tax refund as they have had it for 4 weeks and I am anxiously waiting my return so I may afford to take kids and myself to dentist. Guess what...thank you so much for your administrative error CSL....Revenue Canada has taken my tax refund...all of it. Back on the phone to CSL. After a lengthy discussion regarding their incompitence....superviser at CSL/Tricura decides that their is no need for an investigation into this matter that there was a major mistake made and asks for the loan to immediatly be returned to CSL. After many back in forth phone calls between Revenue Canada and CSL it is determined that the only thing that I can do is file for a partial refund of my tax refund with Revenue Canada, which I must add, is not a guarantee that I will recieve this money. Basically I have to fill out this income/ expense report for Revenue canada and thier assessment team will decide if I "need" the money. If they feel that that I make enough money then they keep it and apply it to my loans. This whole process apparently can take around six months. I am so angry that me and my family have to suffer for this mistake that CSL has made. I was also told in the same conversation that I need to be on constant contact with Revenue Canada over the next couple of weeks to make sure that my wages are not being garnished until this gets sorted out. All this I have to jump through even though revenue canada has been sent notice that the loans are in recall, and that this is CSL's fault. In my opinion...this was not my fault. I did everything that was required of me, CSL has admitted that it was their mistake, I think revenue Canada should just be issuing my refund no questions asked. I tell you I owe them money and they charge interest on me out the ying yang...they owe me money and I get no interest do I....any advise or just knowing that someone else has gone through this would be great. Thanks in advance!!!

If there is an administrative error made that caused your default, and they admit it is their mistake, then they are required to claw itr back. Unfortunately, CRA - once they are involved, they have an agenda of their own and that is to scoop as much money as they can for the crown. Lots of people have had this happent po them, many of which (over the years) are still in default with no remedial action by the system to reverse it.
 
You are early out of the gate with this so what you must do is make some more noise about it. Get names of who you speak with, record times, and record some calls. If you want call recordings we can help you with that if need be.
 
This way you can demonstrate their screw up and that they refuse to fix it. That is what they fear most in these types of cases. It is when people don;t properly record data and calls that allows them to get awaty with this nonsense.

I have done this and I have also written my MP...Basically now I guess I just play a waiting game until my package comes in from revenue canada and then fill it out and play the game again....so frusterating

So, I just got a call from my local MP office, and have a meeting with them later today. They are going to try and help me get my refund back and are apparently going to help me look into what actually happened at Student Loans. Acording to them this is happening all too often. Funny thing is that I had to call Student Loans again today as my payment is supposed to be paid at the end of this week and they have requested that I not make the payment as I would normally and I am to wait until the loan that has been recalled is back in their hands at which point the will contact me via telephone to inform me that they do have it again in their hands and I have to to another revision of terms with them. I documented this call and also informed Student Loans that I was documenting this call. Got their name, numbers and reiterated to them what they had told me which was in my own personal notes. The girl was actually flustered. She even asked me why I was being so diligent with our conversation....i basically told her, that I got dicked around once and I certainly was going to do my damndest to make sure it never happens again.

Yes, and if you follow that advice (stop paying) from the agent at NSLSC then you risk them not noting the file and having another problem.

If something happens and you have no proof that someone told you to stop paying then you like you stopped paying and they can shift the blame on you by denying that ever being said.

OK. so here is an update....I got the package in the mail from Revenue Canada wanting me to fill out my income and expence report so that I can attemt to get my tax refund back. I started filling it out but at the very bottom it basically states that by signing this package I acknowledge that I owe HRSDC all this money from my student loans. I decided last night that I am not signing that as I dont owe hrsdc anything. I owe Canada Student Loans. This morning I get a call from the MPS office that I went to go to last week, and he kindly informs me that my loans have been transferred back to CSL and not to sign any paperwork that revenue canada/ or hrsdc has sent to me because it is no longer needed. He then said it is no longer needed because I have successfully retrieved your tax refund. Apparently the check was put in the mail yesterday. He told me to CSL should be contacted myself in the next day or two to let me know that I can pay my payment from this month, as he too was told on a recorded call that they did not want me to pay my payment until my loan was back in their hands. I told him to keep that recording just in case there was an issue and he said that he would, and that if I ever have any problems with my student loans again where there is neglect on their behalf to please call him, and he was getting the impression that this was a problem.....So now to just recieve me check and I can say alls well ends well...except now I have to make CSL fix my credit rating.

What is it that you want CSL to fix regarding your credit rating?
 
I assume that you do not have a current Credit Report from either Equifax or TransUnion.  If that is so, you can order a FREE Consumer Disclosure Report from either or both Equifax or TransUnion.  When you receive it, examine it carefully to see if this mixup is shown on either Report. 
 
If nothing is shown on either Report regarding this matter, then there is nothing to fix.
 
I would be extremely surprised if your loan that was sent to the CRA to have your refund seized was reported on a Credit Report.  Keep us informed as to what you find.

Call Service Canada and ask them if there is an outstanding CSL in recovery. Their # is   
1-800-622-6232.
 
HRSDC and the Canada Student Loans Program are one in the same. CRA does the collections for HRSDC. All you would be doing is acknowledging that you owe the debt, which is a guarenteed Canada student loan.
 
If they mismanaged your student loan account and defaulted it in error then they are required to patch up any derrogatory narratives or descriptions. I know who you can contact if there are any negatives as a result of their own errors. If this does happen let me know and I will put you in touch with the right person(s).
