This website is a testimony to the problems Canadian Student Loan borrowers experienced from approximately 1996 to 2008 and until their loans were paid off.

The privatization of the Student Loans system by the Chretien and Martin Liberal governments broke the system and defaulted thousands of borrowers who were trying to pay their loans. There were even stories of suicide due to the harassment of borrowers.

Canada Student Loans-The Need for Change Fortunately the new Conservative government at the time revamped the program and fixed the system for new borrowers, but borrowers under the previous program were left with ruined credit and continued harassment from debt collectors.

I call on the Canadian Government to apologize to the borrowers affected by this fiasco and make amends.

Unfortunately the Liberal government is again clobbering the Education system with their changes to International Student Visas. Yes, there's a problem, but instead of a well thought out plan, they have pulled the emergency brake on the train causing a derailment. This has introduced unprecedented instability for both private and public education institutions who serve both international and local students.

Universities have been forced to cancel programs and layoff hundreds if not thousands of full-time and contract instructors.

Again, the Liberal government has messed up the education environment.

In 2002 , my husband and I jointly filed a consumer proposal, the bulk of which was student loan debt. we completed it in 2005/2006.
My last student loan was from 1996, and his was from 2000.

In 2008, we filed for relief from our student loans in the supreme court in Nova Scotia, and I was granted relief from my remaining student loan debt due to hardship ( two of our three kids have significant health issues and I stay at home with them, which prevents me from being employed), and the fact that we had acted in good faith in paying off our debts ( via the consumer proposal).

I was awarded relief from all my loans, and the registrar found that my husband should also be granted relief at the end of the 10 year period from the date of his last loan ( it was an OSAP loan from a privately run college that had gone into receivership and closed down about two week after he started his classes and had paid his tuition in full).

I thought that was  all behind us, and our attorney told us everything was complete. Every one in a while, I would get a call from a collection agency about it, and I would explain it to them and fax them a copy of the court decision, and i wouldn't hear anything from them again, and if I tried to contact them , i got no reply.

This morning, I checked my credit score with equifax, and it is tanked because of two RBC student loans , which I was told I had been granted relief from in 2008.

I called the collection agency about it, and the guy wasn't very helpful. He told me that there was part of the student loans that were somehow with RBC and that the court could not have granted me relief from that, just the provincial and federal portions ( even though I explained to him that the loan amounts showing were the exact amounts I was granted relief from, and I'd never had a loan with RBC) and I called RBC, and the lady I spoke with was more helpful, and wants me to fax her a copy of the court decisions and summary ( I have done that three time already, and have also faxed a copy to the collection agency several times)

I am totally confused about what is going on. Should I just leave it alone and equifax will purge it from their records, or should I contact equifax with a copy of the court decision and ask them to remove that entry ( student loan). Will giving the RBC or collection agency the information just get everything mixed up all over again?
I am totally lost.
any input would be greatly appreciated.

Collection agencies goal  is to make a profit/commission by collecting the debt whether you owe it or not.  They have no interest in helping and will lie to you.

Its possible that with the loan regime changes you might have 4 to 6 different loans.... and maybe one or two got lost and werent included but if thats the case, thats RBC's fault and  they'd likely be statute barred.

Contacting Equifax to dispute it is probably your best option. Johnny at CFWGroup would know what the reporting length would be on these issues.

faxed the collection agency a copy of the courts decision yesterday. called to make sure they received it, and called several times today to speak with the agent I had sent it to. finally got a hold of her, and she told me that the account had been removed and cleared, and she was sure " it would be removed from my credit score"...
I don't believe that, so I'll have to do that myself.

spoke with a collection agency (CVM) agent, about having these removed from my credit score with the different credit reporting agencies, and I got the impression they either had no idea what i wanted, or  that they had no interest in helping ( was told that she needed to speak with her supervisor and to call back in an hour)
will do so, but if I am not satisfied with the response, I will send the agency a letter I drafted making my request to have these accounts removed from my credit score or at least have them send me a letter indicating that these accounts with them have been cleared and should no longer be reflected on my credit score since they should never have had them in the first place. and letting them know how dissatisfied I am ( i was outright lied to) . If that doesn't work, I will file a complaint against them.

If I am correct you contacted our office yesterday about this. If that is you the advice I had given you on the spot was to send the certificate of comp[letion and the court deocument citing relief from the student loans to the Ontario government's MTCU and collection management unit in Sudbury. It was in reference to an Ontario student loan, yes?

Yes, that is me :)

the OSAP loan was my husband's, and that has been cleared and is not a problem ( it doesn't show up on his credit score  ).

the two loans that were showing up on my credit score were the remaining amounts  from student loans of mine from the early 90's  that had "survived" the consumer proposal. Under the terms of the supreme court decision, the registrar of that court in nova scotia determined that I met the terms outlined in the consumer proposal, and because of hardship I needed to stay at home with two of my children who health issues ( these will be lifelong and will not really change). Thus, I was granted relief from all my student loans. (2008)

based upon what i have been told, these were "mistakenly" sent by RBC to collections, and even though the collections ( and RBC) knew that I had been granted relief, they still show up in my credit score as amounts showing in 2009. Over the years, i have made the collection agency well aware ( including sending them copies of the courts decision) that I had been provided relief from these loans, yet they were still there.

I didn't know that until Monday when I checked my credit score ( something I now firmly believe everyone should do from time to time).

I spoke to gentleman from the collection agency, who tried to tell me i did owe this amount and said that the court couldn't have granted relief, and that it was some other loan through RBC (?) and tried to get me to agree to a payment schedule.. I told him he was wrong, and even contacted RBC, who understood what was going on. I called the collection agency back and spoke with different people yesterday, before finally reaching someone who told me to fax her a copy of the courts decision ( I did), and I called three time today to find out what was going on. they told me the account was now closed, but that was all they could do...they couldn't take the 2009 entry  off my credit score.
I finally got a hold of a supervisor there, who was actually quite helpful and told me that the amounts would be removed from 2009 and would now show up as part of the original consumer proposal which was completed in 2007. He said that should be purged three years after 2007 ( 2010). He also told me I should never have been told I still owe those two amounts.

It was quite confusing, and no one  I spoke to ( except this one guy) seemed to want to help at all. I understand that collecting accounts is their "bread and butter", but their behavior was not acceptable. Especially the lying. After I had spoken with the person who told me they couldn't remove those 2009 entries from my credit score, I asked to speak to her supervisor. She was ticked, and gave me a non existent extension, and said her supervisor was "in a meeting". Turns out, the gentleman I reached half an hour later ( by asking the receptionist to ask to speak to a supervisor about an urgent issue) WAS her supervisor and had not been in any "meetings"

guess perseverance pays off.
( and thank you for being kind and answers all my panicked questions yesterday...it was greatly appreciated)
