This website is a testimony to the problems Canadian Student Loan borrowers experienced from approximately 1996 to 2008 and until their loans were paid off.

The privatization of the Student Loans system by the Chretien and Martin Liberal governments broke the system and defaulted thousands of borrowers who were trying to pay their loans. There were even stories of suicide due to the harassment of borrowers.

Canada Student Loans-The Need for Change Fortunately the new Conservative government at the time revamped the program and fixed the system for new borrowers, but borrowers under the previous program were left with ruined credit and continued harassment from debt collectors.

I call on the Canadian Government to apologize to the borrowers affected by this fiasco and make amends.

Unfortunately the Liberal government is again clobbering the Education system with their changes to International Student Visas. Yes, there's a problem, but instead of a well thought out plan, they have pulled the emergency brake on the train causing a derailment. This has introduced unprecedented instability for both private and public education institutions who serve both international and local students.

Universities have been forced to cancel programs and layoff hundreds if not thousands of full-time and contract instructors.

Again, the Liberal government has messed up the education environment.

In some jurisdictions (BC, for one) no surety is required. In fact, it doesn't even take a judge to sign the order. An ex-parte Application for a bank account Garnishment Prior to Judgment requires nothing more than a prima facia case (usually the originating documents are sufficient) and an affidavit in support thereof, that includes a statement on the part of the creditor that there is reason to suspect the funds will be moved. The Court Registrar can grant the Application. If he or she is not sure, the matter will go before a judge who will usually grant it unless there is reason to suspect that the creditor is using it as  harrassment or as a punitive measure.

The Application is often made and granted on the same day that service of the Notice of Claim is effected. Usually the process server swears the Affdavit of Service within moments of service and faxes it to the agent in the registry office who then slaps the Application and Affidavit in front of the Registrar. When it's granted it is raced down to the debtor's bank and served on the manager. Funds can be scooped while the debtor is still trying to figure out what the Claim is all about. Service of the debtor's copy of the Garnishment Order isn't usually seen to be so urgent.

BTW, it is not really all that rare. It is done routinely.

Thanks for your comments.......however this is not really helping me.....I have stated my case on numerous occassions to these weirdos from Mark Silverthorn however they claim they are continuing the actions.......I also recieved a call from a RCMP officer from MOntreal over 1.5 yrs ago asking if I applied for mothers allowance in that city.  I have never lived outside of Ontario in my life and the person applying for welfare also used my sons name and date of birth.  I dont know how many other debts or how much trouble I can really be in at this point with my ID being stolen.  I have spoke with my parents in regards to this and for me to get my life & credit fixed I think I should be filing bankrupt (I can at least keep my car due to I require it to go to work).  It will get these CAs off my back and stop me from having another heart attack.  I am only 36yrs old and have heart trouble and this stress doesnot help at all.  I need some solid advise.  Im going today to get a copy of my credit report from credit bureau and will for sure know how much trouble this b*tch has got me in.  What do I do?

 Mark Silverthorn has represented a number of collection agencies during the past few years. Collectcorp - then to CBCL. Now, he is off to another collection agency. He hops around from agency to agency more than actual collectors do it seems.

 If you are a victim of identity theft, then all you have to do is contact the ombudsman's office of the alleged lender - call for action to get this straightened out. You have said that you did not accrue this debt, and have been a victim of identity theft. Write a letter, fax it, then email it to the CIBC's office of the Ombudsman to the attention of Mr. Joseph Timar.

THis office MUST investigate this if you are claiming to be a victim of identity theft - and an account was created in your name by someone else. It is a security issue that ALL banks take seriously and are required to investigate. There is your solution.

Thanks Johnny but I have a strong feeling that there is more out there piling up that I am just not up to dealing with.  According to RCMP officer that I spoke with this person has recieved a few payments in my name.  As you can probably tell I am frustrated, fed up and just getting depressed about this.  I have worked hard to keep my life with my son together but now I cant.....I have no fight left in me anymore.  My health is suffering and I dont want my son going into foster care.  I have spoke to a lawyer the last time my identity was stolen (I was about 18yrs old) he advised me I dont have enough money to fight Visa so I paid it and showed as collections on my credit report.  If I file bankrupt then it takes 3 years to clear and I can at least get some kind of credit (lease a new car if needed) if this isnt cleared then Im screwed for 7 years.  When does the statute of two years take effect?  From the time the card is opened or from the time the debt reaches collections?  I have alot of questions and cant seem to get answers to them other than from you.......thanks again

Concerned,

 If you are a victim of identity theft, the RCMP is reuqired to investigate it - and do something about it - espcially if you can prove it.

 any fruadulent acquisition of credit by a perpetrator who has stolen another's identity is something the bank is required to investigate once it has been brought to their attention.

If a lawyer told you that you do not have enough money to fight visa - and you have proof that you did not sign any agreement, that speaks a thousand words about a professional at law that obviously doesn't know law.

All you have to do is substantiate that you do not owe it. Your signature is your signature. If it is not on any loan or credit agreement - you are in the clear. That is the bottom line. 

You would be going bankrupt on debt that you do not owe?

how do I get the officers information that HE called me about......I dont remember his name and the file# he gave me......I was being naive thinking that it was caught and nothing more would come of it.......yes I would be going bankrupt on something I dont owe but I would be able to start over again without having people hounding me

Concerned, I agree with the underlying concept of why you want to go bankrupt.  You're tired and you just want it over.

Johnny has a good point though in that if you could argue that that isn't your debt, would you still have to go bankrupt?  Is it too late?  You might be one that would be better off in using Johnny (versus going bankrupt) in the sense that he may have better luck resolving your underlying issues as you just sound tired.

As well, once you go bankrupt are you safe from it happening again?

I've argued with Johnny about bankruptcy because I'm not against it, but, that said, I think you have to ensure that all your t's are crossed and i's dotted to ensure it does resolve the issue.  It's not a magic pill so you have to make sure that things are truly resolved (that past credit problems won't reoccur in the future after the bankruptcy because then you're REALLY in it).

My identity wont be taken again in future whereas no one has my new SIN # (not even the place with my current car loan or my employer).  I never give out personal info to ANYONE.....no one has anything any more......my DLN has been changed since my id was stolen (I have been divorced and went back to my maiden name).........yes I am just tired of eveything and want a fresh start.....maybe a new city & new start is what I need.........bankruptcy is forever on  my mind......I have one debt that I have encurred and thats my car......I dont have credit cards or bank loans, lines of credit,store credit....nothing..........cause I know I cant afford to pay these things.........now I am being screwed (I think by one of my ex husbands pieces of tail hes had).....I will have to get more information on what going bankrupt entails and what I need to do
