This website is a testimony to the problems Canadian Student Loan borrowers experienced from approximately 1996 to 2008 and until their loans were paid off.

The privatization of the Student Loans system by the Chretien and Martin Liberal governments broke the system and defaulted thousands of borrowers who were trying to pay their loans. There were even stories of suicide due to the harassment of borrowers.

Read the report that I prepared back in 2007 here. Canada Student Loans-The Need for Change Fortunately the new Conservative government at the time revamped the program and fixed the system for new borrowers, but borrowers under the previous program were left with ruined credit and continued harassment from debt collectors.

I call on the Canadian Government to apologize to the borrowers affected by this fiasco and make amends.

Unfortunately the Liberal government is again clobbering the Education system with their changes to International Student Visas. Yes, there's a problem, but instead of a well thought out plan, they have pulled the emergency brake on the train causing a derailment. This has introduced unprecedented instability for both private and public education institutions who serve both international and local students.

Universities have been forced to cancel programs and layoff hundreds if not thousands of full-time and contract instructors.

Again, the Liberal government has messed up the education environment.

So I need some advice.  Here is my situation.

I finished full time post secondary in November, 2007.  I  was diagnosed with an unusual sleeping disorder and have medical documentation stating that I could no longer continue my education, or even drive, until it was addressed.  I managed to address it in 2008 by getting out of an abusive relationship.  The sleep specialist that I saw assumed that my disorder was cause by emotional stress and I'm happy to say I've been fine ever since!

I unfortunately was stuck with about $45,000 of debt and that's not including my student loans.  In February, 2010 I gave up trying to live pay check to pay check and declared bankruptcy.  I was discharged in November, 2010 and the only debt that was carried forward was my student loans.  In January of 2011 I thought I would be pro-active and start paying towards my loans before they were notified that I had been discharged.  I wasn't able to pay very much, about $200 per month, but at least it was something.

In December, 2011 I received a document from our local small claims court stating that a "judgment" had been passed and my wages were to be garnished as of my next pay.  I actually work for a college and we close for a week at Christmas so I was unable to follow up with our Payroll person until January.  I did attempt to contact the Law Firm that had sued me and asked why I wasn't informed prior that this was going to happen and wanted to know what happened to the payments I had made.  I found out that about a month prior to me filling for bankruptcy my loans had been sold off to a law firm to collect for Canada Revenue.  My payments were just sitting with Canada Revenue and not being applied to anything.

Today I receive a phone call from Total Credit Recovery stating that I also owe $6,000 for the Ontario Student Loan portion (I had no clue that there were two separate places to pay) and they want full payment by May 17th, 2012.

I'm at a total loss of what to do.  I am currently netting 50% of my gross pay as the CRA is garnishing 30% and of course the rest goes to taxes and a Pension Plan that all College employees have to pay into.  I currently owe CSL $24,000 and OSL $6,000.  Can the company representing the OSL portion also apply to have my wages garnished?  If so, would there even be a point in working anymore?

Just a side note...a friend of mine who works for TD said that sometimes they offer personal loans and lines of credit to customer that have good payment history.  I've had my car with TD finance for 1 year and have never missed a payment of been late on a payment, even when we were on strike.  Would it be in my best interest to get a bank loan and just pay these dam loans off?

Any help or advice would be appreciated.

The legal agent is Spiteri Ursulak for the CSL portion and Total Credit Recovery for the OSL portion.  Should I contact you through your website?  Thanks again!
