This website is a testimony to the problems Canadian Student Loan borrowers experienced from approximately 1996 to 2008 and until their loans were paid off.

The privatization of the Student Loans system by the Chretien and Martin Liberal governments broke the system and defaulted thousands of borrowers who were trying to pay their loans. There were even stories of suicide due to the harassment of borrowers.

Canada Student Loans-The Need for Change Fortunately the new Conservative government at the time revamped the program and fixed the system for new borrowers, but borrowers under the previous program were left with ruined credit and continued harassment from debt collectors.

I call on the Canadian Government to apologize to the borrowers affected by this fiasco and make amends.

Unfortunately the Liberal government is again clobbering the Education system with their changes to International Student Visas. Yes, there's a problem, but instead of a well thought out plan, they have pulled the emergency brake on the train causing a derailment. This has introduced unprecedented instability for both private and public education institutions who serve both international and local students.

Universities have been forced to cancel programs and layoff hundreds if not thousands of full-time and contract instructors.

Again, the Liberal government has messed up the education environment.

I took out a student loan in 2004, and unable to complete studies. Statue of limitation on that was March 30th 2011. I had moved and was not contacted at all throughout the years until Feb 24th 2011 where I received a package from a lawyer stating they were taking me to court. That was approx 2 weeks before my loan reach the statue of limitations.

I filed my taxes every year, yet this is the first year they took any of my income tax.

My current financial situation is below poverty, I cannot even afford to declare bankruptcy. I am a single mother of  3 dependents, including a newborn and suffer from a disability.

My mother paid the court fee of 50 dollars to file a reply to the lawyer, we attended a pre-trial conference, where I explained my financial situation, they did not accept an offer of 50 dollars a month, and are wanting a full payment of approx 11,000.00.

I have the trial coming up at the end of April and am terrified of the outcome.

My question is this. Due to my dire financial situation, what happens if I cannot pay?
Do they send people to jail over non-payment?

I cannot find any legal help as this falls under the category of small claims and the government cut funding for legal aid.
Any advice would be greatly appreciated.

There is nothing for them to attach if you have no income. The only reason they sued you is to keep the debt alive and away from the limitation finish line. The proceedings will simply end with them acquiring a default judgment with no avenue of execution based on what you described as your current financial position. 
 
In order for me to assist you I need to know the history of your interactiona nd business witht he student loan system, and the extent of your hardship over the past number of years. There are ways to deal with this without having to hire an attorney at $400.00 per hour. The justice system recognizes that people cannot afford to fight it because of the costs involved. If you owe the momney - you owe it. You are not denying that obviously. So, in my opinion, your next move should be to convince HRSDC and it's ministry that you are unable to pay and releif benefits should be opened up for you, just as they are for other people who are in the same or similar predicament as you.
