This website is a testimony to the problems Canadian Student Loan borrowers experienced from approximately 1996 to 2008 and until their loans were paid off.

The privatization of the Student Loans system by the Chretien and Martin Liberal governments broke the system and defaulted thousands of borrowers who were trying to pay their loans. There were even stories of suicide due to the harassment of borrowers.

Canada Student Loans-The Need for Change Fortunately the new Conservative government at the time revamped the program and fixed the system for new borrowers, but borrowers under the previous program were left with ruined credit and continued harassment from debt collectors.

I call on the Canadian Government to apologize to the borrowers affected by this fiasco and make amends.

Unfortunately the Liberal government is again clobbering the Education system with their changes to International Student Visas. Yes, there's a problem, but instead of a well thought out plan, they have pulled the emergency brake on the train causing a derailment. This has introduced unprecedented instability for both private and public education institutions who serve both international and local students.

Universities have been forced to cancel programs and layoff hundreds if not thousands of full-time and contract instructors.

Again, the Liberal government has messed up the education environment.

Hi....here is some hope....
 
i declared bk in oct 2003 b/c i was sued by an american student loan company.
 
it was discharged in 2005 b/c it is NOT a CANADA student loan.
 
my 25,000 canada loan remained.
 
i've been paying interest only about 150+/- for 4 years since my interest relief expired.
 
since my "bankruptcy related event" occured prior to "may 11, 2004" I was not able to qualify for debt reduction (stupid policy).
 
my trustee said i could NOT get it included in that bk even after my ten years was up.
 
well......the law changed the 10 year rule.
 
i spoke via email with a lawyer who said that the fee would be $2500 plus plus plus to make the application.......and would be difficult to get accepted.
 
my trustee still didn't think it could work.
 
so i drafted my own motions and went to court this morning and voila! my loans are GONE GONE GONE.
 
I am so relieved. It cost me hardly anything to do. but was VERY stressful being in court (again).
 
1. draft a motion
2. make an affidavit of facts
3. make an affidavit of mailing.
4. get 1,2,3 notorized (i did it at city hall ~$25)
5. mail 1,2 to CIBC and Government (registered mail) about $15 total
6. hand delivered a copy of #1 to the office of the super. of bk
7. submit 1,2,3 to the bankruptcy court and pay $10
8. schedule a time when your motion can be heard. (do this before doing number 1)
9. hope and pray until that date.
10. bring 1,2,3 (just so you have a copy to read from)
11. bring a "order" for the registrar to sign
12. wait with all the lawyers etc until you are called
13. present your motion, he was impressed that I did it myself.
14. if approved, give him the "order", he'll sign it.
15. celebrate a huge burden to be lifted.
 
note: cibc filled a letter stating that they had not time to respond, he did not by that argument, so timing is critical...you don't want to give them too much time. no one else showed up.

If you meet the criteria outlined in section 178 (and the new changes),  discharge is possible, more so with bank risk debt. However, the governments make sure their opposition is tabled. The banks would have to oppose also, but they are slow to respond, as in your case. If you owed the govenrments, you would not have had this outcome.

i don't want to come of as sounding like the process was simple.
 
it is pressure b/c you do not really know what you are doing.............
 
you are not a lawyer.....
 
you show up in court by yourself (and others that having motions heard...mostly lawyers)....unless somebody objects.....
 
 
 
it is very intimidating.
 
the "judge" actually said "are you here alone"......yes......"wow....i'm impressed" ....thank you....."where is CIBC"....i dunno....."well I drove by many of them.........they could have at least sent a teller"........i suppose......."motion passed.....do you have the order"......no...didn't know i had to supply it....."well why don't you bring one back and I'll sign it''.....ok!

I don't have the information on a website to link to. They are just 'word' documents that I had to type out by hand based on information that I reseached.
