This website is a testimony to the problems Canadian Student Loan borrowers experienced from approximately 1996 to 2008 and until their loans were paid off.

The privatization of the Student Loans system by the Chretien and Martin Liberal governments broke the system and defaulted thousands of borrowers who were trying to pay their loans. There were even stories of suicide due to the harassment of borrowers.

Canada Student Loans-The Need for Change Fortunately the new Conservative government at the time revamped the program and fixed the system for new borrowers, but borrowers under the previous program were left with ruined credit and continued harassment from debt collectors.

I call on the Canadian Government to apologize to the borrowers affected by this fiasco and make amends.

Unfortunately the Liberal government is again clobbering the Education system with their changes to International Student Visas. Yes, there's a problem, but instead of a well thought out plan, they have pulled the emergency brake on the train causing a derailment. This has introduced unprecedented instability for both private and public education institutions who serve both international and local students.

Universities have been forced to cancel programs and layoff hundreds if not thousands of full-time and contract instructors.

Again, the Liberal government has messed up the education environment.

I started a plan with student loans to pay back $300 a month for 3 months while I tried to get a second mortgage on my house. I emailed them May 23rd after a phone call, giving them my chequings account number, and permission to withdraw $300 on these specific dates:

June 2nd, July 14th, August 18t
All these dates I got/get paid, automatic deposit, and it goes in my account around 12:30ish PM.

I got a call today from the same woman I was dealing with from student loans, and she said on June 2nd, and July 14th that there was NSF in my account. She said I committed fraud and can get in serious trouble. She also told me my entire student loan was due for payment today. <-- (This doesn't make sense because I still had one month of relief time before it came down to this.)

I have a printed out copy of the email I sent them, with the exact bank account # from my bank statement, and my statements for both June and July, and the money was there. I printed these out after the phone call, but during the call I already knew the money was there and I gave them the right info.

At this point when she told me I commited fraud and that I had to pay my entire student loan back today I was so angry I said. "What do you expect me to do, pull the money out of my ass?" Then she said I'll be getting a very nasty second call, she won't be speaking to me again, and hung up.

They obviously screwed up my payments on their end, I gave them all the right information, the money was there in my account, do I have to hold their hand while they withdraw it?

Would this fall under something a collector can't do?

What can I do to rectify this? I have all the papers that prove they messed up, and I can't even find a fax number on HRSDC website. Is my only option talking to someone else on the phone, spend an hour explaining my situation and try and get a fax number from them?

Who said this? That is ridiculous.

First, this is why it is dangerous to allow these groups to perform automatic withdrawals from a bank account. Secondly, this twit of a collector is not criminal law enforcement officer, and it is against the rules for them to even make such a direct accusation. I wish you had this recorded somehow.

Do not worry about the fraud accusation. Certainly it is offensive to have someone say such a thing to you, but you will not face any legal reprucussions for an NSF in Canada. The annoying part of this (besides the insult) is that whether they screwed up or not they are still going hold you responsible for the payments they missed taking!

It sounds like your automatic deposit is available before an automatic withdrawal would happen in the day. You said it's there at 12:00 noon so it's not a matter of the withdrawal occuring before the deposit. In any case there are usually two attempts to withdraw on separate days.

What may have happened is student loans has incorrect routing info to your bank account and the withdrawals are not happening. I would contact my bank and obtain the correct routing info to my savings or chequing account then get in touch with student loans and verify with them to rule out an error on their part. You probably have all three of those payments set aside still so you can either have them catch you up or you can mail them a money order for the missed payments. Either way that should staisfy them. If you no longer have those funds available then it may become a bit more of a problem to sort out.
