Topic: Urgent help needed... Posted: 14/October/2004 at 8:54pm |
Hi Guys ...
I'm new to this site. hopefully someone can help me out here... I recieved a call yesterday from some lady from canadian bonded credit limited informing me that they required me to pay the 10,000 dollars i owe to osl and csl within 3 business days or they would take me to court and sue me for the amount. Since then they've been calling me and asking for my lawyers number so i presume they're pretty serious about this. The problem i have is that i have never been out of school. I've bin in school for the past three years, I started university in the fall of 2002 and i financed my education though osap... I did not do well in my first year and i had to withdraw from the university for a period of one year. I started going to a community college in the fall of 2003 (full time) for academic upgrading. I applied for osap again in the fall of 2003... they asked for a letter showing my expenses... Eventually i decided not to go with osap and borrowed from my parents for tuition. This year i'm back in school but i've bin placed on academic probation... and i'm only allowed to be part-time.
Anyways, to make a long story short, I would like to know what my options are, I cannot pay these guys right away as i do not have a job at this time, I cannot borrow from any one, I have looked into filing bankruptcy... but that does not seem to be a viable option. I have tried talking to the national student loans center but they say that my file is no longer with them. I am still very young and do not wish for my life to be ruined by bad credit... and also .. it is very doubtfull i'd be able to finish my education without osap... I am extremely stressed out and any sort of help will be appreciated a lot.

Deep breath. They will not sue. They are trying to scare a big payment out of you.
Relax. If they call back, tell them that you want a statement of account to be mailed to your address. Tell them that until you tell them differently, all communication is to be in writing. Tell them you will contact them when you have seen the statement.
If they call back get the collector's name and licence number and file a complaint immediately. And tell them you will pursue it. If possible record every phone call from them.
Now. Go through this site and do your homework on what they can or can't do. They've already broken the law by threatening legal action. They will break it again if you haven't learned your rights. After you have a better picture of what's going on, post us again and let us know where things are....we'll help you.
But relax. This is part of the game. They are LYING and they will lie about everything. We can help you.

Thanks Islander ... very helpful response.
Some people find these forums through google and as a result, dont see the main page. When they register, they may be taken back to the forum... it is something I should check into... and try to fix...
KD - Go to the main page http://www.canadastudentdebt.ca and read under under Frequently Asked Quesions, and Student Loan Info...
there is a link to dealing with collection agencies...
You can find your rights there!

The collectors have been threatening me on a monthly basis since 1998, that they are going to sue me. They even went on to say that the process server will be at my employer on Friday.
This was 6 years ago.
Don't let them intimidate or harass you.
You deserve better.
Pay them what you can, without starving.
And then tell them where to go.
Good luck

Me too. Five years of the "we're going to sue you" routine. I'm still waiting.

I know in a strange way I kind of want to see what happens if they try to sue me - I would really want to see what a judge would do with that one.

probably laugh the case out of court and make the CA pay all the legal bills, maybe even award us damages for pain and suffering and the like...

one word.........class action suit (whoops...actually that's three ). It is blatantly obvious that the government will not curb its attack dogs.....maybe its time for the courts to neuter the *^#$^^#$#! I find it increasingly hard to defend a system where there is one set of rules for students and another for the rest of the country.

and the system of double standards is what makes us give up after years of beating our heads against the wall trying to play their game only to get screwed over yet again. i have always been responsible (until now, but hard to pay when i have no money) and what did it get me ?? 5 years of lost forms, jumping through hoops and i'm still in default.
