This website is a testimony to the problems Canadian Student Loan borrowers experienced from approximately 1996 to 2008 and until their loans were paid off.

The privatization of the Student Loans system by the Chretien and Martin Liberal governments broke the system and defaulted thousands of borrowers who were trying to pay their loans. There were even stories of suicide due to the harassment of borrowers.

Read the report that I prepared back in 2007 here. Canada Student Loans-The Need for Change Fortunately the new Conservative government at the time revamped the program and fixed the system for new borrowers, but borrowers under the previous program were left with ruined credit and continued harassment from debt collectors.

I call on the Canadian Government to apologize to the borrowers affected by this fiasco and make amends.

Unfortunately the Liberal government is again clobbering the Education system with their changes to International Student Visas. Yes, there's a problem, but instead of a well thought out plan, they have pulled the emergency brake on the train causing a derailment. This has introduced unprecedented instability for both private and public education institutions who serve both international and local students.

Universities have been forced to cancel programs and layoff hundreds if not thousands of full-time and contract instructors.

Again, the Liberal government has messed up the education environment.

Here is my problem - it has become panic time and I can barely sleep at all.  I have student loans from 1993 -97, I now live in Michigan, have gone through a divorce and now remarried.  I was making payments in 1999 for a few years but then things got pretty rough here in Michigan.  I have not made a payment for at least 8 years if not more.?  I have had no contact with anyone regarding the loans.  About a year ago I started getting some government notices stating the amount I owed.  I foolishly did nothing.  Now I have recieved a notice from a local law firm in West Michigan sating that I have 15 days to contact them to make arrangements to pay or they will come after me.  I have read some about what my options are -   I know I cannot afford the payment they are asking for and I don't have much for a lawyer.  I have been told file for bankruptcy but I do not know if that will help.  I guess I am looking for some guidance here.  I keep reading that there is a 6 year statue of limitations???  Is this true ?  Any help would be much appreciated.

There is a limitation period, yes. However, if a law firm has apporached you in the U.S. then there is an action started. It could be one of three things: 1) A fresh action to secure the best interest of the government, which is to prevent a limitation issue from disabling their recovery effort,  2) a call for action on a judgment that they may already have secured previously, or; 3) A bluff to lure you into an admission of guilt or liability to it.

If you want help I can book you in for mediation or an intervention if you really don't know how to approach this.

Yes please.  What am I lookig at as far as cost for your services?  I really have no idea what I am doing.  I can tell you that there are court papers attached to the letter from a judgement against me from 2010 in Ottawa I believe?  I do not have the paperwork with me but I will later today and I can get back to you then.

If thisd is the case then what is going on is item 2 that I pointed out above. They already have a judgment and they are calling you to action. I see these cases quite frequently.

What is your desired outcome here?

I guess my desired outcome is to somehow put this issue at rest.  It went along for so long with nothing happening that I forget about it but then like now, it comes back with a bang.  I know I cannot afford to pay a whole lot especially with my current job.  I guess I am just looking for the best possible outcome.  I am looking for new employment which if I can secure it then I would be able to pay more.  Thoughts?

If you cannot pay what they require of you then they will try to muscle you to pay something that is close to it, even if you cannot. That is how the traditional and government collection outfits work. It is all about money and not truth.

So, if I understand you correctly, you want to make arrangements to pay an amount you can manage, have a safeguard in place so they have no further reason to press or proceed with legal action, and then once it is all in place, seek out other opportunities that might save you time and money in respect of the debt problem. That is something I or anyone with CFW Group can do.

Cost is very basic for this but it depends on the scope of work. I can tell you the cost would range between $400 and $500. for the immediate remedial work. If there is an opportunity afterwards that we can find that will provide you with a significant financial benefit, such as having the student loan completely set aside due to hardship (and any extenuating circumstances or debt reduction) then we will determine those costs if the opportunity presents itself. Everything is based on scopes of work, which is the most cost effective way for you and I. Cost/benefit is quite clear with this particular scope.

Just remember that damage control, protection, and relationship is the remedy and benefit you should be focused on here. Then, the hunt for opportunity or further benefit after. Wink

Hope this helps!

First off - thank you for the guidance.  You help calm a very upsetting situation.  Secondly, how do I proceed from here then.  I have thought about it and I just cannot coninue the way it is.  I know I cannot pay anywhere near what they are asking.

All I need you to do is email me so we can strategize a bit and put together an action plan. Then I will execute that and fix your problem for you:) Just go to www.cfwgroup.ca and click on the contact page and send me a note from there, and identify who you are by screen name here. That is the quickest way.

You don't have to do anything that is labour intensive. I minimize that right away :) Also, don't worry yourself sick. THis sort of thing is routine here. Just have to have the right plan and approach it the right way.
