Hi there,
I went to university from 1999-2004 and I had student loans each year. After completing university I was unable to find a job and took whatever I could find just to survive on my own and unfortunately I had to default on my student loans. After years of struggling I finnaly was able to find full time work so I contacted the CRA to set up a payment plan to repay my defaulted loans. So, for the last 2 years I have been making my monthly payments. Then all of the sudden about 3 weeks ago a creditor called me at my work and was pretty rude to me saying that I had a $8500 debt from RBC student loans and that I had to pay immediatly or he was going to sue me and garnish my wages. He actually contatced me as I was leaving work to go on vacation to get married, this put a damper on my vacation. Anyway, they told me that they had been sending me notices in the mail for this student loan debt which was totally not true. I had not heard of this loan in 12 years! Since then they have been calling me 4+ times a day, calling me at work and demanding that I pay this loan. I spoke with the credit burreau yesterdayand she told me to get a loan from citi financial to pay off the debt at no later than 4 pm today or I will be sued.
My questions is, can they sue me? This loans is over 12 years old and is the first I have ever heard of it. I am not in a finacial postion to pay off this loan in one chunk however I would like for it to eventually be done with.
Any bit of advice would be greatly appreciated.

Not if it is statute barred. I would borrow money from a high interest loan joint either. That is asking for trouble. If you want to find out if it is barred you can contact me privately.

I am just wondering if anyone has been in a similar situation. I contacted Sandy for the Canadian Credit Bureau today and she said that my only option was to get a loan from a fiancial institution. I told her I would not do that and she responded by asking if I wasn't going to make any payments on this loan. I said I would like to make monthly arrangements or even settle. She said if I am willing to do that why wouldn't I get a loan. I told her that I knew she had to say that to me to get a payment and she responded by saying at 3pm today she would be filling the papers. What does that mean? What shoulod I expect next? Thanks...

Canadian Credit Bureau sounds like a collection agency with a fuzzy name meant to confuse people a bit into thinking they're working for you. They are paid by commission and push hard for you to pay off the whole thing so they can collect their commission upfront.
They are using scare tactics to try to get a payment out of you. At the top of the website there is a menu....read up on Dealing with Collection Agencies etc.... filing papers probably is a bluff to try to scare you. In all truth the agent will probably be rolling papers at 4:20 :)
You can expect them to continue to call, and even if you work out an agreement they will smell money and ask for more.....

Hahaha I hope you are right! She was pretty bitchy to me on the phone. I did read through this website first and knew what she would say to me. When I told her I knew she wanted me to get a loan just so she could make some money off of me she was not too happy.
I guess I will just wait and see what happens next...

If they smell money they are like sharks after the smell of blood. THey thrive on commission revenues and, of course, the things they do and say to get it are incredible.

So the creditor who I spoke to yesterday got her boss to call me today (at work even though I told them never to contact me there) and informed me that their "client" is willing to make a counter offer to settle since I had told them yesterday to go ahead and fill those papers.
Should I try and get their "clients" contact info to directly speak to them or just call this BS and tell them to continue with the filling of their papers...?

I just spoke with the same creditor and he told me that RBC is willing to settle on $4300 of the $8500 loan. Should I take this offer or wait it out?

MAKE SURE YOU GET THE OFFER IN WRITING BEFORE YOU SEND ANY MONEY!!!!!!
I'm typing this in CAPS for a very good reason! :) This was a previous tactic to get money and then backtrack on the offer. Do not send any money until you get a written statement that this offer will settle the loan completely.

It is likely a barred RBC or Scotiabank student loan.

Hello, After constant harrasement at work and to my personal phone number I told these creditors that I cannot pay the "debt" all at once so they can go ahead with their next steps (whatever that means). They stopped calling for about a month and now they are calling me at work and harrasing me again. I got a credit report from equifax and there is no record of this debt whatsover. Can they still take legal action against me since this is now off of my credit report? Thanks, Jen

Yes. That is correct. You pay my small hard costs and out of pocket expenses for a retainer and the remaining balance when it is all done as per a scope of work and agreement. Can;t give you a total cost until I do the preliminary analyis for case strength, and of course whether or not you can afford to pay me for my labor. Johnny

You approached me before and I gave you an assessment and a quote should you want to engage me or someone from my team concerning limitation issues. You would have been advised that this is not a free service. You couldn't afford it, as quoted above. In your post above you say that you want to make payment arrangements or settle the student loan. If this is the case then why are you quizzing me on limitation issues then?
