Topic: RAP Denies based on Spouse Posted: 10/February/2010 at 1:49pm |

DENIED.
I was on interest relief. They had no problem then... so why now??
The stupidity of these people and their paperwork is insane. I applied for the RAP program put down the last day of January 2010, instead of Feb 1. So I have refaxed with the feb 1 date.
Now I am told they refuse to file my application without a third party letter in regards to my wifes income. My wife is an american, has never lived in canada, no sin, no income tax return, no residence, no nothing, no application to move to canada... (plan to go there once the economy fixes up)
The laws of Canada do not extend to any sovereign nation or citizen of that said nation. Therefore her income does not come into play.
I am now dealing with CSL directly and I am appealing to them, I have also placed 2 calls to the ministers office that have gone unanswered.. I will call again tomorrow and tell them I want to talk to someone.
now what else is there to do???

This is a very good question. I'm interested to see what happens here.
This is just one of the reasons I'm not getting married. I'd never want to drag my girlfriend through my debt, and I wouldn't want to be dragged through hers. Getting married only solidifies your debts, and hamstrings you when applying for government funding or relief.

Well, if she is in the USA then their demand is unreasonable. Your partner has rights and privacy is one of them. If they refuse to help you because your partner in another country does not want to disclose her personal details that could very well be descrimination. Canada looks more and more like a dictatorship. Anyone else agree?
This is compared to a thug pointing a gun at you and telling you that he will pull the trigger unless your partner spills her personal information.
If you have any problem,s and end up in default over this you have to let me know.

Denying someone a benefit on the basis of family status is discrimination. Discrimination is allowed based on a class if it allows someone to provide a better benefit. I am concerned that if you are denied, then the government has an implied agenda of spouses being responsible for the debt.

What it does is imply that a spouse does not have his or her own freedom of choice and right to privacy. Yes, it also does imply that a spouse of a borrower is responsible to pay the debt in a case whereas the system assesses the ability to pay based on some else's level of income.

I agree with you on the privacy issue, and I talked to the people at the privacy commission and they can take up to 1 year to make a decision... so there is reality for you its either underfunded or something... in the mean time, they would go around in circles and say I owed money and then put it into collections with rev can while I waited on that decision... I have talked to the Canada student loans group above the service center... have filed papers with them already, I doubt I will hear anything from them till next week at least... In the mean time I got word because I re-faxed info again with a proper date because the forms are vague and the idiots that work there can not give CORRECT instructions on anything, I call 5 times and get 5 different answers to the same question. Everything seems to be based on assumption in that office... In the FYI department, if anyone has pulled their credit reports that had a private loan they will see two loans on their account one from before and one from when they changed your account number... here is the thing, if you were in bad standing on the old account number that will fall off in 2013 regardless of how long the loan was for... I agree that this country looks more and more like a dictatorship.. I like to call it a democratic dictatorship in where we elect our dictators :p
