Hello all....I'm the "Fresh-Meat" of the week...LOL
Has anyone heard of this off-shoot of the Waffen (sp) SS??
These scum bags, who are harrassing me about my CSL to the tune of $5,755.46, were telling me that "..it's illegal to pay one creditor and not another.." and "...that my credit is not bad YET..." and "....I see that you have a Master Card in good standing and an AMEX in good standing and a vehicle loan in good standing...." and that "..their client will not accept the amount of $60.00 per month that you are offering..." and "...you should step up and tack care of your responcibilities...." and "....we will see what we can do.....we will have a talk with the people dealing with your vehicle loan...." and "....we will put this on your credit report...." and "...we will give you 1 week to come up with full payment, if you will not do this, we will do what we have to do....." and basically screaming overtop of me and not accepting what I had to say....
Well....I heard from these clowns today and tried to tell this moron on the phone that I could not come up with the full amount and I had tried everyone I knew. He wanted to know who and what institutions I went to.
Of course I stuck to my guns and told him "This is what I'm prepared to do. I will send a series of checks in the amount of $60.00 per month to you....".
I got the big screaming and yelling match from him again. So. I remained calm and stated it again. Then I said : "Ok...here's the deal....now....all corispondance to me will be done in written form...sent by registered mail....". And the yelling was on again!!!
So ...the phone call finally ended with him saying "....ok....fine....we know whre you work.....goodnight..".
So...my next move is to come good on what I said by sending a letter, stating my intentions and 12 cheques for $60.00 each, with the stipulation "...by cashing these cheques, you are in agreement with my terms...".
2 questions to Johnny (and probably more later :) ) :
1) Do I have to tell them where I went to ask for money?
...and
2) AM I GOING ABOUT THIS THE RIGHT WAY??

You are almost at the exact same dollar amount as I am with my Collectcorp debt. I also have the other portion of my loan in good standing, and have decided to focus the bulk of my efforts on getting these birds to stop delivering their bird droppings into my mailbox and telephone answering system. Luckily my financial situation has improved to the point where I am now able to throw down some big payments over the past little while. I can look forward to closing this probably by around February or so.
At $60 per month, you are at least paying about $20 towards the principle each month. For several years all I was managing to pay was $50 per month. If you set them up as a payee on your online banking, you will have the option to drop a little extra on top of what you are doing if you ever feel so inclined. Every little bit more towards the principle can help get that debt down to more manageable levels. The important thing is to stay in control and feel as though you are doing this on your own terms.

Well...as I stated...I have no problem seeting up payments or setting them up with the online banking. But they were not even willing to talk about any thing other than full payment AND THAT'S IT...END OF DISCUSSION...NO EXCEPTIONS!!
So....they will get what I can afford to give them. If I have a little extra....no problem.
If they decide they are going to be nasty again.......I will contact my lawyer and seek out Johnny as well.
I'm just wondering who else they are doing this to......
The other thing that puzzles me is.....why would banks and/or CA's get so militant with people that owe a ton more than me ($30,000 $40,000 or more....)? And why would they tack on retarded amounts of interest that they will never ever collect, even if they take everything they have and garnish their wages???
It would make much more sence to me for the banks to lobby the Gov. to bring down tutions to a more reasonable amount so people won't be out in the street trying to pay loans off and they could work with the people and would get their loans back (with less interest) and still make some money.
I'm sorry.....am I making sence?? I REALLY have to stop doing that...

Well...I'm back...
Now they are sending a lawyer after me. He just happens to be AFFILIATED with Accounts Recovery Corporation.
The " We expect to be in recipt of instructions from ScotiaBank Student Loan within seven days to commence legal action against you...."etc....
I think legal action is required at this point....what do you think???
Johnny...your thoughts (if you din't mind me asking you again...)?
The letter was dated 25 Sept/07 and I got it today (Oct 01/07).

LMAO!!!
Wow!! You are good!!
Mr. Saha. I have drafted a letter to send to the Manager (Steve Dupis) of ARC.
Here is a copy of it :
Mr. Steve Dupuis
Accounts Recovery Corporation
4240 Glanford Ave. , Suite 100
Victoria, B.C.
V8Z 0A1
Dear Mr. Dupuis,
During my converstation wiht Mr. Scott in a phone call on September 5th/2007, I stated that I was prepared to make payments on this account. The amount that I’m able to pay is $60.00 per month, starting November 2007. This what I can afford at this time.
You will find enclosed, 12 post dated personal cheques for the amount of $60.00 each. By cashing any of these enclosed cheques, Accounts Recovery Corporation and your client agrees to the above terms.
And I also would appreciate that any further contact be made in written form.
Thank you.

There are so many stories about BAD collectors - I have many of my own
- I felt compelled to say that I have dealt with one very kind man, who
listened to my explanation of my past financial difficulties, and
actually worked WITH me, to design a realistic payment schedule.
His name is Robert Scott, and he's the Collection Supervisor, at Manitoba Student Aid.
I'm
on a mission to rid myself of my loans, because for the first time in
my life, I actually can. And they're to the tune of $40,000 (they were
about $65,000 this time last year). My point is that I am seeing to it
that Robert gets his money first, as I have decided to reward an
organization - the Government of Manitoba - that actually treated me
like a person, and not just an account.
So, kudos to Robert
Scott - - I can't believe I'm singing the praises of a student loan
collector, but this guy made me feel good about myself.
Regards,
Paul

You are perfectly correct in how you went about this. Collection agencies like ARC donto write the law, though they imply they do. Stick to your gunns.

Thanks for your vote of encouragement, Allison. But...Johnny talked me out of sending that letter. He is handling things for me right now.
Don't get me wrong...I was gonna send that letter because they treated me like something they scraped off their shoe...and that's not right. People have stuff happen in their lives that tend to screw up plans. Banks and collection agencies are going to have to understand that. IMO, the sooner they do, the more co-operation they will get!
But, I guess you would get better results from kicking a rabid panther in the gonads!!
I can't get into details, but I'm lovin' what I'm hearing...and I think Johnny is too.
So actually....I have a hired gun!!
He's also dealing with an issue for my fiancee (sp) too!
I'm tellin' ya...if you have had an issue with these clowns....call Johnny. He knows how to deal with these guys!!
