This website is a testimony to the problems Canadian Student Loan borrowers experienced from approximately 1996 to 2008 and until their loans were paid off.

The privatization of the Student Loans system by the Chretien and Martin Liberal governments broke the system and defaulted thousands of borrowers who were trying to pay their loans. There were even stories of suicide due to the harassment of borrowers.

Canada Student Loans-The Need for Change Fortunately the new Conservative government at the time revamped the program and fixed the system for new borrowers, but borrowers under the previous program were left with ruined credit and continued harassment from debt collectors.

I call on the Canadian Government to apologize to the borrowers affected by this fiasco and make amends.

Unfortunately the Liberal government is again clobbering the Education system with their changes to International Student Visas. Yes, there's a problem, but instead of a well thought out plan, they have pulled the emergency brake on the train causing a derailment. This has introduced unprecedented instability for both private and public education institutions who serve both international and local students.

Universities have been forced to cancel programs and layoff hundreds if not thousands of full-time and contract instructors.

Again, the Liberal government has messed up the education environment.

Hi, I've been following this website for afew years now.  I think it's time I post my problem. I'm hoping that someone can help me with my issue...
I took out student loans back in 1991-1996 while attending the University of Toronto.  I made payments after graduating, but then I moved to the US in 2000.  Several months after moving I received a call from a collection agency telling me that my Scotia student loan had gone into default.  They threatened to ruin my credit history, and not knowing much about collection agencies at the time I negotiated with them and made arrangements to pay off approximatey $5,000. The agreement was that the collection agency would not report their involvement to the credit bureau if I completed the payments.   I sent post dated cheques (I cant remember which agency) and the payments were made. I thought I was paying my entire loan off and no record of the debt going into collections ever appeared on my credit report.  
I returned to Canada in 2005 for one year and my income tax refund of about $3000 was taken by the goverment. I was shocked and called CRA. They informed me that the amt was taken to repay the federal portion of my loan still owing. I moved back to the US the next year (2006).  Now it's 2006 and I'm getting calls from Nordon collecting on behalf of Scotia stating that I owe $47,000!  Well i explained that i had already paid the amount off  in 2001, and the government took their portion from my income tax refund.  Of course they said that was not true and wanted proof. Unfortunately I never got a letter and had no proof.  I attempted to get copies of the cheques I sent, but was told by the bank (which had now been taken over by another bank) that they would have to search records for the cheques (back then nothing was computerized like now),and they would have to charge me per hour, and they had no idea how long it would take to do the search. So I gave up on that and since then I have been dealing with collection calls from Nordon, CBV  and NCO. They keep rotating. 
I returned to Canada last year with no plans to leave.  Last year I contacted CRA and they confirmed that I no longer owed anything.  However, I am still receiving calls from collection agencies.   Right now it's CBV.  I dont know how to get them to stop. I think they got my contact information from my credit report because when I applied for a report, I had put in my new address and phone number (big mistake).  I usually avoid them or return their letters which had been sent to my parent's home over the years. 
I finally spoke with CBV today and explained that the loan was paid. They told me that I did not pay the risk portion of the loan??  I thought the gov't took the Ontario and Federal portions, and I paid the risk portion back in 2001.   The CBV agent said that it sounds right that I made payments in 2001, but I would need to show proof.  I called the Scotiabank student loan centre and the lady there said that what I paid in 2001 was the CSL portion.  when I told them that back then I did not deal with CRA,but with a collection aency, she said back then the gov't was using collection agencies too to get the money.  I am so confused, now I don't know who I paid and what exactly I was paying.
 
I am wondering if I should just ignore CBV altogether.  Fortunately I have good credit and a good job.  I recently bought a house, there is no evidence of me owing anyone anything on my credit report. CBV knows this, even making reference to my recent purchases. They keep making inquiries on my credit report.  CRA says I owe nothing, and there is no record of a debt outstanding.  The only thing is that Scotiabank has it in their records that my student loan is unpaid.  I found that out when I was shopping for mortgages.   However, I dont plan on ever banking with them anyway.
 
I've considered contacting the student loan centre to get copies of all my loan documents to review.  I feel like scotia is scamming me, but I have little understanding of my loans at this point.  I wish I han't taken out any loans.  Back then I was so young and naive and knew nothing about credit and collections. 
 
Any suggestions on how to proceed?  Anything anyone can clarify for me?  Your feedback would be appreciated.  I have been dealing with this for the past 12 years and am totally fed up. Confused

Unfortunately, what you are describing is a Scotiabank risk loan. This is the portion that is not guaranteed by the feds.
 
The bank and agencies will pursue you for the debt for as long as they can. If there is a limitation issue and you want to excercise your right to enjoy that benefit and freedom, then you have to act on it.  I can help you but it is a scope of work and there is a fee. But - I do not provide this particular assistance to those who have benefitted from the education received, are able to pay without hitch, cannot demonstrate that they have acted in good faith, and present no past or present hardship that made it impossible to pay at the time - or in a lifetime, etc. I have helped people who have led me to believe they wanted to do the right thing but found out mid way that their intentions were to frustrate the entire system rather than comply with it. The result is  the big boot (and me being cussed out and badgered because I refuse to participate in such wreckless activity). Your debt is rather large and I could see there being a hardship somewhere along the line, for sure. The misinformation about who is who and what is what is also quite alarming.
 
If there is no limitation issue, and you are a home owner, then you can expect that they try to use that to secure their best interests. They can use the legal system to secure themselves and make things rather difficult for you. Whether or not they actually can or will is yet an unknown matter.
