This website is a testimony to the problems Canadian Student Loan borrowers experienced from approximately 1996 to 2008 and until their loans were paid off.

The privatization of the Student Loans system by the Chretien and Martin Liberal governments broke the system and defaulted thousands of borrowers who were trying to pay their loans. There were even stories of suicide due to the harassment of borrowers.

Read the report that I prepared back in 2007 here. Canada Student Loans-The Need for Change Fortunately the new Conservative government at the time revamped the program and fixed the system for new borrowers, but borrowers under the previous program were left with ruined credit and continued harassment from debt collectors.

I call on the Canadian Government to apologize to the borrowers affected by this fiasco and make amends.

Unfortunately the Liberal government is again clobbering the Education system with their upcoming changes to International Student Visas. Yes, there's a problem, but instead of a well thought out plan, they have pulled the emergency brake on the train causing a derailment. This has introduced unprecedented instability for both private and public education institutions who serve both international and local students.

Universities can't plan. I've heard of courses being cut because the government has no process in place for universities to send the newly required acceptance letters to the government.

This means that students who have been accepted can not attend courses that start in the summer 2024 semester. With cut sections, current Canadian students will have trouble getting courses, and may have to switch to part-time which changes their enrollment status and might trigger repayment of their loans or ineligibility for funding. I've seen this before. It wreaks havoc on the student loan borrowers.

Again, the Liberal government has messed up the education environment. Will the new system needed in a rush for the acceptance letters be the new Arrivecan scandal?

I call on the government to implement a slower phased in approach and delay the requirement of the acceptance letters until a process is in place to submit these letters.

Hello,
I live in Toronto and regularly get calls from TCR.  They even called me last week at my employer, which I think is not allowed?

On the loan in question, I owe about $8000.  This loan dates back to the 1990s.  I called them back and offered to pay $15/month if they stopped harassing me.  I was hoping they would counter with a higher, but still affordable figure, like $30 or even $50/month.  They did not.

They said, either:
1, Pay all 8k back in whole (by asking a friend or family member, or getting a loan), or
2. Pay Over $300/month

There was no middle ground.  I got pissed and said "Take me to court".  He said "Ok. We will let the Ministry of Finance know to do just that."

My questions:
1. Are they legally required to accept any payment plan?
2. Can they legally tell me to take a loan to repay this?
3. Can they legally call me at work? (I advised them at the time not to do that)
4. Did I make a mistake saying "Take me to court"?

Thanks!
Sue J.

When did you last make a payment or acknowledge the debt in writing?

Do not make a payment if its been more than 6 years.  I am not suggesting that you shouldn't pay it back at this stage.  Just use the statute of limitations to repay it on your own terms rather than getting it jammed down your throat through legal action etc.

The loan might be statute barred but any payment will result in your losing that status. Don't write anything to them until you read up on this sub-forum...

Thank you for the replies.

Here is more info.  I last voluntarily made 3 payments of $50 for 3 consecutive moneths about a year ago.  Then I stopped paying.

That aside, I involuntarily pay every year.  There is a lien against my tax refunds, so all of my refund is gobbled up by this loan (and possibly other loans -- I am not sure of the logistics.)

I am happy for any info, so share anything you want with me.  As well, again, I am wondering:

1. Are they legally required to accept any payment plan?
2. Can they legally tell me to take a loan to repay this?
3. Can they legally call me at work? (I advised them at the time not to do that)
4. Did I make a mistake saying "Take me to court"?

1. The law says they're legally required to accept a payment, but not a payment arrangement.
2. Yes, sure.  They can't force you to, but it's possibly a valid suggestion.  It's not in your best interest to stay in collections.  If you don't have the money to pay off your loan, but you can move it to a new loan that isn't in collections (and with no tax lien), then this will have a positive affect on your credit.
3. Yes, if you are in Ontario.
4. No, they don't need your permission to take you to court.  That doesn't mean they will.
